《邯郸市规范性文件管理办法修正案》已经2017年11月12日邯郸市人民政府第14次常务会议审议通过,现予公布,自2018年1月1日起施行。

The Amendment to the Measures of Handan Municipality on the Administration of Normative Documents which was adopted on the 14th executive meeting of Handan Municipal People’s Government on November 12, 2017, is hereby promulgated and shall come into force on January 1, 2018.

邯郸市规范性文件管理办法修正案
Amendment to the Measures of Handan Municipality on the Administration of Normative Documents
一、第一条修改为“为了维护社会主义法制统一,加强对规范性文件的监督管理,保证政令畅通,根据《河北省规范性文件管理办法》(省政府令〔2016〕第5号)的规定,结合我市实际,制定本办法。”
1. Article 1 is amended to read: “With a view to maintaining the uniformity of the socialistic laws system, enhancing the supervision and management of the normative documents, and ensuring the unimpeded implementation of government orders, these Measures are formulated in accordance with the Measures of Hebei Province on the Administration of Normative Documents (the Provincial Government Decree [2016] No.5), and in the light of the actual circumstances of this Municipality..”
二、第二条修改为“本市行政区域内的规范性文件的制定、审查、公布、备案、清理及监督管理,适用本办法。”
2. Article 2 is amended to read: “These Measures are applicable to the formulation, review, promulgation, archival filing, cleaning up, supervision and administration of normative documents within the Administrative District of Handan Municipality..”
三、第九条第一款修改为:“规范性文件的名称,一般称办法、规定、决定、细则、通告、规则、意见等。”
3. The first paragraph of Article 9 is amended to read: “The names of normative documents are generally called Measures, Provisions, Decisions, Detailed rules, Announcements, Regulations, Opinions, etc.”
四、第十一条修改为:“规范性文件不得设定行政许可、行政处罚、行政强制、行政事业性收费和征收、减免税费等事项,不得设定应当由法律、法规、规章设定的事项,但在上位法规定的种类、范围、幅度内予以细化和补充的除外。”
4. Article 11 is amended to read: “The Normative documents shall not set items such as administrative licensing, administrative penalty, administrative compulsion, administrative fees, tax reduction or exemption, etc., shall not set matters that should have been set by the law , except for those that are specified and supplemented within the categories, scopes and ranges prescribed by the upper rules.”
五、增加一款作为第十二条第二款:“对公民、法人和其他组织权利义务产生重大影响的规范性文件,还应当向社会公开征求意见,公开起草说明和规范性文件文本,时间一般不少于15日。”
5. One new paragraph is inserted as the second paragraph of Article 12 to read: “The normative documents that have a significant impact on the rights and obligations of citizens, legal persons and other organizations shall also be open to the public for soliciting opinions, the explanatory notes and draft text of normative documents included. It is usually not less than 15 days for soliciting opinions.”
第十二条第三款修改为:“征集的意见、建议,制定机关应当认真研究采纳,不宜采纳的,应当予以说明,并采取适当方式告知提议人。”
The third paragraph of Article 12 is amended to read: “The enacting authorities shall carefully study and adopt the opinions and suggestions solicited. If the opinions are not appropriate, authorities shall provide explanations and inform the persons that solicited the opinions in an appropriate manner.”
六、增加一条作为第十三条:“可能存在风险的规范性文件,起草单位应当对规范性文件草稿进行风险评估,评估内容包括社会稳定、公共安全、劳动就业、社会保障、环境保护、交通管理、法律纠纷等方面的事项,确定风险等级,形成风险评估报告,并提出防范、减缓或者化解措施。
6. One new article is inserted as Article 13 to read: “For the normative documents that may have risks, the drafting authority shall conduct risk assessment on the drafts. The assessment shall cover matters related to social stability, public safety and tranquility, employment, social security, environmental protection, traffic management and legal disputes, etc. The Risk Assessment authorities shall assess and report the level of risk involve and propose measures to prevent or mitigate the risk.
“起草单位应当根据评估风险等级及时提出继续制定、暂缓制定或不予制定的建议。对于存在风险并建议继续制定的,应当根据风险等级提出详细应对预案,及防范、减缓或者化解措施。”
“The drafting authority shall, in accordance with the assessment of the risk level, timely put forward suggestions for further formulation, for deferred formulation or for no formulation. For the normative documents with risks and suggestions made for further formulation, a detailed plan for addressing the possible risks, measures for prevention, mitigation and resolution, should be proposed, according to the risk level.”
七、第十三条作为第十四条,修改为:“规范性文件应当规定施行日期和有效期,有效期届满未明确延续的,规范性文件自动失效。规范性文件有效期最长不得超过5年,文件名称冠以‘暂行’、‘试行’的,有效期不得超过2年。”
7. Article 13 is changed to Article 14 and amended to read: “The normative document shall carry on it the date of implementation and the duration of validity shall be specified. If the duration of validity is not extended or renewed, the normative documents shall automatically become invalid after the specified duration is exceeded. The duration of validity of normative documents shall not exceed 5 years. If the name of the document is marked with "interim" or "trial", the duration of validity shall not exceed 2 years.
八、第十六条第一款修改为:“市、县级政府的规范性文件草案,统一由政府办公厅(室)主要或分管负责同志审签给同级政府法制机构进行合法性审查。政府法制机构将合法性审查意见报同级政府办公厅(室)后按程序制发文件。”
8. The first paragraph of Article 16 is amended to read: “The draft normative documents of municipal and county levels governments shall be uniformly examined and signed by the responsible staff in the office (general office) and be submitted to the government’s Legislative Affairs Office of the same level for legitimate review. The government’s Legislative Affairs Office shall submit opinions on the review on legality to the office (general office) of the government at the corresponding level. Then, documents shall be prepared and issued according to the procedure.”
九、第十五条作为第十七条,第一款修改为:“报请市、县级政府发布的规范性文件,起草单位应当提供制定说明。
9. Article 15 is changed to Article 17, and the first paragraph thereof is amended to read: “The drafting authority shall provide the formulation instructions for the normative documents submitted to the municipal and county-level governments for publication.
第一款修改为:“政府法制机构应当在5个工作日内完成审查,最长不得超过15个工作日。因特殊情况不能在规定期限内完成审查的,经法制机构负责人批准,可延长10个工作日。”
The first paragraph thereof is amended to read: “The government Legislative Affairs Office shall complete the review within 5 working days, without exceeding 15 working days. If the review cannot be completed within the stipulated time limit due to special circumstances, the review may be extended for another 10 working days upon the approval of the person in charge of the Legislative Affairs Office。”
增加一款作为第二款:“合法性审查以书面审查为主,必要时可以采取补充征求意见、召开座谈会、协调论证、实地调研等方式进行,所需时间不计算在合法性审查期限内。”
One new paragraph is inserted as the second paragraph to read: “The legitimate review shall be mainly conducted in written form. If necessary, it can be conducted by means of supplementary soliciting opinions, holding symposiums, argumentation as exogenous coordination, field research and so on. The time required is not counted within the period of legitimate review.”
十、第二十二条作为第十九条,第一款中的“前置审查”,改为“合法性审查”。
10. Article 22 is changed to Article 19, and the expression “pre-examination” in the first paragraph thereof is replaced by the expression “legitimate review”.
第二款修改为:“政府或部门法制机构可以委托本机关的法律顾问、律师事务所、相关领域的专家执行合法性审查任务,但需以法制机构的名义出具审查意见。”
The second paragraph thereof is amended to read: “The government or her Legislative Affairs Office may entrust her legal counsel, a law firm or experts in related fields to perform the task of legitimate review, but the review opinions shall be issued in the name of the Legislative Affairs Office.”
第三款修改为:“受委托的个人或单位应当在规定时限内完成审查工作,并对审查意见的合法性、真实性负责。”
The third paragraph thereof is amended to read: “The entrusted individual or unit shall complete the review within the prescribed time limit and shall be responsible for the legality and authenticity of the opinions on legitimate review.”
十一、第二十三条作为第二十条,第(三)项中“行政强制措施”,改为“行政强制”。
11. Article 23 is changed to Article 20, and the expression “administrative coercive measures” in the item (iii) thereof is replaced by the expression “administrative compulsion”.
增加一项作为第(四)项:“是否有妨碍统一市场形成的地区封锁、行业垄断的内容。”
One new item thereof is inserted as the item (iv) to read: “Whether its content encompasses issues regarding regional blockade or trade monopoly that hinders the formation of the unified market;”
十二、删除第十八条。
12. Article 18 is deleted.
十三、第十九条作为第二十二条,第一款修改为:“两个或者两个以上部门联合发布的规范性文件,发布机关的法制机构均应进行合法性审查。”
13. Article 19 is changed to Article 22, and the first paragraph thereof is amended to read: “For a normative document jointly issued by two or more organizations, the Legislative Affairs Office of every organization involved shall conduct a legitimate review.”
删除第二款、第三款。
The second and third paragraphs are deleted.
十四、删除第二十条、第二十四条。
14. Article 20 and 24 are deleted.
十五、增加一条作为第二十三条:“政府或部门法制机构对规范性文件进行合法性审查,应当按照下列规定出具审查意见:
15. One new article is inserted as Article 23 to read: “The government or the Legislative Affairs Office shall put forward review opinions on the legality of normative documents in accordance with the following:
“(一)规范性文件内容符合法律、法规和相关政策规定的,出具内容合法的意见;
“(i) Where the contents of normative documents comply with relevant laws, regulations and policies, the opinions shall be issued legally;
“(二)规范性文件部分内容不符合本办法第二十条规定的,出具建议修改的意见;
“(ii) Where parts of the normative documents do not comply with the provisions of Article 20 of these measures, suggestions for amendment shall be issued;
“(三)规范性文件主要内容不符合本办法第二十条规定的,出具不合法或重新起草后报送审查的意见。
“ (iii) Where the major contents of normative documents do not comply with the provisions of Article 20 of these measures, the opinions shall be issued as illegal or requiring for review after re-draft.
“提请集体讨论或签发的规范性文件应当如实列明法制机构的审查意见。向法制机构发函征求意见,或者邀请法制机构参加座谈,法制机构的函复意见、会签或者在非正式活动上表达的意见,不属于合法性审查意见。
“The normative documents submitted for collective discussion shall truthfully state the review opinions of Legislative Affairs Office. To send a letter to a Legislative Affairs Office for solicitation of opinions, or to invite the Legislative Affairs Office to participate in the panel discussion, the legislative affairs office’s replying letter, countersignature or the opinion expressed in informal activities do not constitute legal opinion on legitimate review.”
十六、删除第二十五条、第二十六条。
16. Article 25 and 26 are deleted.
十七、增加一条作为第二十四条:“因应对突发事件或者保障重大公共利益等紧急情况需要立即制定规范性文件的,经制定机关主要负责人批准,可以简化规范性文件制定程序。”
17. One new article is inserted as Article 24 to read: “Where it is necessary to immediately formulate normative documents in response to emergencies, for instance, emergency safeguarding major public interests, the procedure for formulating normative documents may be simplified with the approval of the principal person in charge of the enacting organization.”
十八、第二十八条作为第二十六条,第二款修改为:“规范性文件一般不具有溯及力,但授益性的规范性文件除外。”
18. Article 28 is changed to Article 26, and the second paragraph thereof is amended to read: “The normative documents shall not have retrospective effects, except those benefits-rendering normative documents.”
十九、删除第三十条。
19. Article 30 is deleted.
二十、第三十一条作为第二十八条,第二款修改为:“规范性文件制定机关应当在其门户网站、办公场所或市、县级政府指定的集中查阅场所提供本机关制定的规范性文件,供公众免费查阅。”
20. Article 31 is changed to Article 28, and the second paragraph thereof is amended to read: “The normative documents formulated by the authorities shall be provided to the public for free access at the portal websites, offices or centralized places for referring designated by the Municipal or county-level governments.”
二十一、第三十三条作为第三十条,第二款中删除“工商、质量技术监督、食品药品监督”。
21. Article 33 is changed to Article 30, and the expression “industry & commerce, quality & technical supervision, food & drug supervision” are deleted in the second paragraph thereof.
二十二、第三十四条作为第三十一条,第二款中的“第二十三条”改为“第十八条”。
22. Article 34 is changed to Article 31, and the expression “Article 23” in the second paragraph thereof is replaced by the expression “Article 18”
增加一款作为第三款:“报送省政府、市人大常委会备案的市政府规范性文件,起草单位应当在规范性文件印发后5日内向市政府法制机构提交制定说明,由市政府法制机构报请备案。”
One new paragraph is inserted as the third paragraph to read: “If the formative documents are recorded by the provincial or regional government, the drafting departments shall submit the formulation explanations to the Legislative Affairs Office of the municipal government within 5 days after the issuance of formative documents, and then the Legislative Affairs Office of the municipal government shall report to the provincial or regional government for the record.
二十三、第四十四条作为第四十一条,第一款修改为:“制定机关接到公民、法人或者其他组织对本机关制定的规范性文件提出质疑或者修改建议的,应当予以核实并在30日内答复建议人;规范性文件确有问题的,制定机关应当自行改正或者撤销。”
23. Article 44 is changed to Article 41, and the first paragraph thereof is amended to read: “When the enacting authority receives a query or suggestion for amendment to the normative document formulated by a citizen, a legal person or any other organization, it shall verify it and reply to the proposer within 30 days. Where there are problems with the normative documents indeed, the enacting organization shall correct them or cancel them by itself.”
增加一款作为第三款:“公民、法人或者其他组织对制定机关的答复意见有异议的,应当在收到书面答复30日内提出复核建议。政府规范性文件向上一级政府法制机构提出,部门规范性文件向同级政府法制机构提出。接到复核建议的政府法制机构应当在30日内进行复核,并以适当方式反馈复核意见。”
One new paragraph is inserted as the third paragraph to read: “If a physical or juridical person or other organization has any objection to the reply of the enacting organization, it shall put forward a proposal for review within 30 days after receiving the written reply. The government's normative documents are put forward to the government's Legislative Affairs Offices at the next higher level, and the department's normative documents are put forward to the government's legislative affairs offices at the same level. The government Legislative Affairs Office that receives the review proposal shall conduct the review within 30 days, and feedback the review opinions in an appropriate manner.”
二十四、增加一章作为第五章,名称为“清理”。
24. One new chapter is inserted as Chapter V, and it is renamed as “Cleaning up “
增加一条作为第四十二条:“规范性文件清理工作由制定机关负责,各级法制机构具体组织实施。
One new article is inserted as Article 42 to read: “The cleaning up of normative documents shall be undertaken by the enacting authorities, and shall be carried out by Legislative Affairs Offices at all levels.”
“市、县级政府法制机构至少每两年组织一次政府规范性文件全面清理;因法律法规或政策重大调整的,应当适时组织专项清理。
“The Legislative Affairs Offices of municipal and county-level governments shall organize a comprehensive cleaning up of government normative documents at least every two years. In case of major adjustments of laws, regulations or policies, special cleaning up should be organized in due time.
“全面清理和专项清理结果,一般采取公布保留规范性文件目录的方式,也可以将废止目录、宣布失效目录、修改目录一并公布。列入修改目录的规范性文件,应当明确修改完成期限,在规定期限内没有完成修改工作的,视为废止。
“The results of comprehensive cleaning up and special cleaning up shall generally be published to preserve the catalogue of normative documents. Alternatively, the catalogue may be abolished, declared invalid and modified. A normative document included in the list of amendments shall be given a definite time limit for the completion of the revision. If the revision is not completed within the prescribed time limit, it shall be deemed to be abolished.”
增加一条作为第四十三条:“规范性文件实施机关应当根据法律、法规、规章的制定、修改、废止等情况以及经济社会发展需要,及时对本机关制定的规范性文件进行清理,并适时对执行的政府规范性文件提出清理意见。
One new article is inserted as Article 43 to read: “The authorities implementing normative documents shall, in accordance with the formulation, amendment and abolition of laws, regulations and rules as well as the needs of local economic and social development, promptly clean up the normative documents formulated by themselves, put forward the opinions on cleaning up the government's normative documents in due course. The results and opinions shall be sent to the government Legislative Affairs Offices at the same level directly.
“规范性文件有效期届满前3个月,制定机关应当组织清理评估。政府规范性文件的清理评估,由实施部门组织,并提出废止、修改或继续实施的意见,经同级政府法制机构审查后,报同级人民政府决定。
“The enacting authorities of normative documents shall organize evaluation of cleaning normative documents 3 months before expiry date of normative documents. The evaluation of cleaning up of government's normative documents shall be organized by the Implementing Department, which shall put forward suggestions on normative documents’ abolition, amendment or continuation. After the opinions are examined by the Legislative Affairs Offices of governments at the corresponding levels, the decision shall be made by people's governments at the corresponding levels.”
增加一条作为第四十四条:“制定机关应当按照下列规定对清理的规范性文件作出处理决定:
One new article is inserted as Article 44 to read: “The enacting authority shall make a decision on the handling of normative documents for cleaning in accordance with the following provisions:
“(一)内容合法、仍然适用的,予以保留;保留的规范性文件可以延长有效期,但延长期最长不超过5年;
“(i) The normative documents whose contents are legal and still applicable shall be retained. The validity period of these retained normative documents can be extended, not exceeding 5 years;
“(二)内容与法律、法规、规章规定不一致或者不适当的,予以修订或者重新制定;
“(ii) The normative documents whose contents are inconsistent or incoherent with current provisions of laws, regulations and rules will be revised or re-formulated;
“(三)已被新的法律、法规或者规章等规定替代,有效期已过或者调整对象已消失的,予以宣布失效。
“(iii) The normative documents that have been replaced by new laws, regulations, and that have expired or with disappeared objects, will be announced to be invalid.”
二十五、第四十五条第一款修改为:“实行规范性文件报告制度。县(市、区)人民政府法制机构应当通过调阅、抽查制定机关发文登记簿和有关文件等方式,对规范性文件制定和备案情况进行监督检查,于每年第一季度向本级人民政府报告上一年度规范性文件制定、审查、备案情况,径送市人民政府法制机构。”
25. The first paragraph of Article 45 is amended to read: “The normative reporting system shall be implemented. Legislative Affairs Offices at the people’s governments at county level (city and district levels) shall supervise and inspect the formulation and recording of normative documents by means of retrieval, selective review of formulating authorities’ registration list and so on. In the first quarter of each year, the Legislative Affairs Offices of the people's governments shall report to the people's governments at the corresponding level on the formulation, inspection and recording of the normative documents of the previous year, and shall submit them to the Legislative Affairs Office of the municipal people's government directly.”
二十六、第四十六条修改为:“有下列情形之一的,由负责备案审查的政府法制机构给予通报批评;情节严重的,由有权机关对相关责任人依法给予处分:
26. Article 46 is amended to read: ““In any of the following circumstances, the government Legislative Affairs Office responsible for the recording and review shall issue a notice of criticism If the circumstances are grave, the competent authority shall punish the person responsible according to the law:
“(一)未按照规定制定公布规范性文件的;
“(i) Failing to make and publish normative documents as required;
“(二)未按照规定报送规范性文件备案的;
“(ii) Failing to submit normative documents for recording as required;
“(三)未按照规定报送政府规范性文件清理意见的;
“(iii) Failing to submit opinions on clearing of normative documents to the government as required;
“(四)拖延执行或者拒不执行负责备案审查的政府法制机构出具的备案审查意见的;
“(iv) Delaying or refusing to implement in accordance with the record review opinions issued by the government Legislative Affairs Office responsible for it;
“(五)未按照规定答复书面审查建议的。
“ (v) Failing to respond to the written review proposal as required.
二十七、第四十七条修改为:“法制机构违反本办法规定,有下列情形之一的,由制定机关给予通报批评;情节严重的,由有权机关对相关责任人依法给予处分:
27. Article 47 is amended to read: “If a Legislative Affairs Office violates the provisions of these measures, it shall be criticized by the enacting authority in one of the following circumstances. If the circumstances are serious, the competent authority shall punish the person responsible according to the laws in force:
“(一)未按照规定对规范性文件进行合法性审查的;
“(i) Failing to examine the legality of normative documents as required;
“(二)未按照规定对备案的规范性文件进行登记的;
“(ii) Failing to register normative documents for recording as required;
“(三)未按照规定对违法规范性文件进行纠正的。
“(iii) Failing to correct illegal normative documents according to regulations.
二十八、删除第四十八条。
28. Article 48 is deleted.
二十九、第四十九条作为第四十八条,修改为:“市、县(市、区)人民政府及其法制机构可以根据本办法制定具体监督措施。”
29. Article 49 is renamed as Article 48 to read: “The people’s governments at municipality and county level (city and district levels) together with their Legislative Affairs Offices may, in accordance with these Measures, formulate specific supervision measures.”
三十、《办法》中的“审核”均改为“审查”。
30. The each expression “examination and verification” in these Measures is replaced by the expression “review”
此外,对相关条款的序号作相应调整。
In addition, the numbering of the articles thereof shall be adjusted accordingly.
根据本修正案,《邯郸市规范性文件管理办法》重新公布。
The Measures of Handan Municipality on the Administration of Normative Documents shall be re-promulgated after being revised correspondingly in accordance with this decree of amendment.

第一章 总 则
Chapter 1. General Provisions
第一条 为了维护社会主义法制统一,加强对规范性文件的监督管理,保证政令畅通,根据《河北省规范性文件管理办法》(省政府令〔2016〕第5号)规定,结合我市实际,制定本办法。
Article 1. With a view to maintaining the uniformity of the socialistic laws system, enhancing the supervision and management of the normative documents, and ensuring the unimpeded implementation of government orders, these Measures are formulated in accordance with the Measures of Hebei Province on the Administration of Normative Documents (the Provincial Government Decree [2016] No.5), and in the light of the actual circumstances of this Municipality.
第二条 本市行政区域内的规范性文件的制定、审查、公布、备案、清理及监督管理,适用本办法。
Article 2. These Measures are applicable to the formulation, review, promulgation, archival filing, cleaning up, supervision and administration of normative documents within the Administrative District of Handan Municipality.
第三条 本办法所称规范性文件,是指具有规范性文件制定权的单位依照法定职权和程序制定的,涉及公民、法人或者其他组织的权利、义务,在本行政区域内具有普遍约束力、能够反复适用的文件。
Article 3. The term “normative documents” as mentioned in these Measures refers to a document which is formulated and issued by a making organ under the statutory power and procedures, relating to the rights and obligations of the citizens, legal persons or other organization, has a prevalent binding force within the jurisdiction and can be applied again and again.
各级人民政府及其有关部门制定的内部工作制度、人事处理决定以及对具体事项作出的处理决定等,不适用本办法。
These Measures shall not apply to internal working system, personnel processing decisions, and decisions on specific matters and so on, which are formulated by the people's governments at all levels, as well as their divisions.
第四条 规范性文件管理实行层级监督工作制度。市、县(市、区)人民政府分别对下级人民政府和本级政府工作部门制定的规范性文件实施监督管理。
Article 4. The administration of normative documents adopts a hierarchical supervision system. The people’s governments at Municipality and county level (city and district level) shall respectively supervise and administer the normative documents formulated by the people's governments at lower levels and by the departments of governments at the same levels.
市、县(市、区)人民政府应当建立规范性文件管理年度统计报告、监督检查、通报、责任追究等制度。
The people’s governments at the municipality and county levels (city and district levels) shall establish a system of annual statistical reports, supervision and inspection, notification and accountability for the administration of normative documents.
第五条 市、县(市、区)人民政府法制机构具体负责本办法的组织实施。
Article 5. The legislative affairs office of The people’s governments at Municipality and county level (city and district level) shall be specifically responsible for the implementation of these Measures.
市人民政府法制机构应当设立专门工作机构负责规范性文件的监督管理工作,条件成熟的县级人民政府法制机构也应当成立相应的工作机构。
The Legislative Affairs Office of the Municipality of the People’s Government shall establish a specialized working division for the supervision and administration of the normative documents. The relevant agencies shall also be established by the people's governments at the county level if the conditions become ripe.
第六条 具有规范性文件制定权的单位应当建立规范性文件工作程序和制度,指定专门机构和人员负责规范性文件管理。
Article 6. The organizations with the right to formulate the normative documents shall establish a standard procedure and system for the work regarding normative documents and designate specialized agencies and personnel to manage normative documents.
Chapter 2 Formulation
第七条 下列单位可以制定规范性文件:
Article 7. The normative documents may be formulated by any of the following:
(一)市、县(市、区)人民政府及其办公厅(室),乡(镇)人民政府;
(i) The people’s government at municipal and county levels (city and district levels), as well as its office (general office); the township (town) people's government;
(二)市、县(市、区)政府工作部门;
(ii) The departments of the people’s government at municipal l and county levels (city and district levels);
(三)法律、法规授权具有行政管理权的组织;
(iii) The organizations authorized by law to have administrative powers;
(四)其他具有行政管理职能的单位。
(iv) Other units having administrative functions;
临时设置的机构不得单独制发规范性文件。
The temporary agencies shall not formulate normative documents separately.
第八条 规范性文件的制定机关对规范性文件的合法性、适当性负责。
Article 8. The institution that formulates normative documents shall be responsible for any illegality and/or inconsistency in the normative documents.
第九条 规范性文件的名称,一般称办法、规定、决定、细则、通告、规则、意见等。
Article 9. The names of normative documents are generally called Measures, Provisions, Decisions, Detailed rules, Announcements, Regulations, Opinions, etc.
规范性文件不得称“条例”。
The normative documents shall not be referred to as "Ordinance".
第十条 规范性文件用语应当具体、明确、规范、简洁、准确,逻辑严密,内容具有可操作性。
Article 10. The words in the normative documents shall be unambiguous, concise, logical and operable.
法律、法规、规章或者上级规范性文件已经明确规定的事项,一般不作重复规定。
The provisions of the law, rules and regulations, or regulatory documents made by higher authorities that have been clearly stipulated shall not be repeated in the normative documents.
第十一条 规范性文件不得设定行政许可、行政处罚、行政强制、行政事业性收费和征收、减免税费等事项,不得设定应当由法律、法规、规章设定的事项,但在上位法规定的种类、范围、幅度内予以细化和补充的除外。
Article 11. The normative documents shall not set items such as administrative licensing, administrative penalty, administrative compulsion, administrative fees, tax reduction or exemption, etc., shall not set matters that should have been set by the law , except for those that are specified and supplemented within the categories, scopes and ranges prescribed by the upper rules.
第十二条 规范性文件制定应当全过程公开,充分调研论证,采取多种形式听取管理相对人、有关单位以及专家、学者的意见,必要时可召开论证会或者听证会。
Article 12. The formulation of normative documents shall be made public throughout the process, and shall be fully investigated and demonstrated. In addition, the opinions of relative persons of management, relevant units, experts and scholars shall be heard in various forms. Whenever necessary, demonstration meeting or hearing will be held.
对公民、法人和其他组织权利义务产生重大影响的规范性文件,还应当向社会公开征求意见,公开起草说明和规范性文件文本,时间一般不少于15日。
The normative documents that have a significant impact on the rights and obligations of citizens, legal persons and other organizations shall also be open to the public for soliciting opinions, the explanatory notes and draft text of normative documents included. It is usually not less than 15 days for soliciting opinions.
征集的意见、建议,制定机关应当认真研究采纳,不宜采纳的,应当予以说明,并采取适当方式告知提议人。
The enacting authorities shall carefully study and adopt the opinions and suggestions solicited. If the opinions are not appropriate, authorities shall provide explanations and inform the persons that solicited the opinions in an appropriate manner.
第十三条 可能存在风险的规范性文件,起草单位应当对规范性文件草稿进行风险评估,评估内容包括社会稳定、公共安全、劳动就业、社会保障、环境保护、交通管理、法律纠纷等方面的事项,确定风险等级,形成风险评估报告,并提出防范、减缓或者化解措施。
Article 13. For the normative documents that may have risks, the drafting authority shall conduct risk assessment on the drafts. The assessment shall cover matters related to social stability, public safety and tranquility, employment, social security, environmental protection, traffic management and legal disputes, etc. The Risk Assessment authorities shall assess and report the level of risk involve and propose measures to prevent or mitigate the risk
起草单位应当根据评估风险等级及时提出继续制定、暂缓制定或不予制定的建议。对于存在风险并建议继续制定的,应当根据风险等级提出详细应对预案,及防范、减缓或者化解措施。
The drafting authority shall, in accordance with the assessment of the risk level, timely put forward suggestions for further formulation, for deferred formulation or for no formulation. For the normative documents with risks and suggestions made for further formulation, a detailed plan for addressing the possible risks, measures for prevention, mitigation and resolution, should be proposed, according to the risk level.
第十四条 规范性文件应当规定施行日期和有效期,有效期届满未明确延续的,规范性文件自动失效。规范性文件有效期最长不得超过5年,文件名称冠以“暂行”、“试行”的,有效期不得超过2年。
Article 14. The normative document shall carry on it the date of implementation and the duration of validity shall be specified. If the duration of validity is not extended or renewed, the normative documents shall automatically become invalid after the specified duration is exceeded. The duration of validity of normative documents shall not exceed 5 years. If the name of the document is marked with "interim" or "trial", the duration of validity shall not exceed 2 years.
第十五条 制定规范性文件必须经制定机关的法制机构进行合法性审查。
Article 15. The legitimate review of a draft normative document shall be conducted by the Legal Affairs Office of the drafting department.
As for making the normative documents shall be conducted the legal review by the legislative affairs office at the corresponding level, before the review submitted to the government; as for the normative documents of the government including the normative documents formulated by the departments jointly, the legal system of the department shall conduct the legal review. As for those failing to be conducted the legal review, shall not be examined.
未经制定机关法制机构合法性审查的规范性文件,不得提交领导人签署或集体研究。
The normative document shall not be submitted to the leaders for deliberations and/or signatures without legitimate review by the Legal Affairs Office of the Drafting Department.
乡(镇)人民政府制定规范性文件,应当经专(兼)职法制工作人员提出审查意见,也可以报请县级人民政府法制机构审查后发布。
When a township (town) people's government formulates a normative document, it shall be examined by a full-time (or part-time) professional specializing in the legal system for suggestions and opinions. Also, it may be submitted to the Legislative Affairs Office of the people’s governments at county’s level for review, and then the normative document can be published.
第十六条 市、县级政府的规范性文件草案,统一由政府办公厅(室)主要或分管负责同志审签给同级政府法制机构进行合法性审查。政府法制机构将合法性审查意见报同级政府办公厅(室)后按程序制发文件。
Article 16. The draft normative documents of municipal and county levels governments shall be uniformly examined and signed by the responsible staff in the office (general office) and be submitted to the government’s Legislative Affairs Office of the same level for legitimate review. The government’s Legislative Affairs Office shall submit opinions on the review on legality to the office (general office) of the government at the corresponding level. Then, documents shall be prepared and issued according to the procedure.
重要的规范性文件应当经政府常务会议或全体会议研究。
The important normative documents shall be studied by the executive or plenary meetings of the government.
第十七条 报请市、县级政府发布的规范性文件,起草单位应当提供制定说明。
Article 17. The drafting authority shall provide the formulation instructions for the normative documents submitted to the municipal and county-level governments for publication.
政府法制机构应当在5个工作日内完成审查,最长不得超过15个工作日。因特殊情况不能在规定期限内完成审查的,经法制机构负责人批准,可延长10个工作日。
The government Legislative Affairs Office shall complete the review within 5 working days, without exceeding 15 working days. If the review cannot be completed within the stipulated time limit due to special circumstances, the review may be extended for another 10 working days upon the approval of the person in charge of the Legislative Affairs Office。
合法性审查以书面审查为主,必要时可以采取补充征求意见、召开座谈会、协调论证、实地调研等方式进行,所需时间不计算在合法性审查期限内。
The legitimate review shall be mainly conducted in written form. If necessary, it can be conducted by means of supplementary soliciting opinions, holding symposiums, argumentation as exogenous coordination, field research and so on. The time required is not counted within the period of legitimate review.
第十八条 规范性文件制定说明的内容应当包括:
Article 18. The contents of the formulation instructions of normative documents shall include:
(一)制定规范性文件的依据、必要性;
(i) The basis and necessity of formulating the normative document;
(二)规定权利、义务及法律责任的依据;
(ii) The basis for stipulating rights, obligations and legal responsibilities;
(三)主要争议问题的协调情况;Coordination of major contentious issues;
(iii) Coordination of major contentious issues;
(四)其他需要说明的问题。
(iv) Other questions to be further addressed.
第十九条 政府法制机构可以采取直接审查、委托审查等方式,对规范性文件进行合法性审查。
Article 19. The Legislative Affairs Office of government may examine the legality of normative documents by means of direct or commissioned reviews etc.
政府或部门法制机构可以委托本机关的法律顾问、律师事务所、相关领域的专家执行合法性审查任务,但需以法制机构的名义出具审查意见。
The government or her Legislative Affairs Office may entrust her legal counsel, a law firm or experts in related fields to perform the task of legitimate review, but the review opinions shall be issued in the name of the Legislative Affairs Office.
受委托的个人或单位应当在规定时限内完成审查工作,并对审查意见的合法性、真实性负责。
The entrusted individual or unit shall complete the review within the prescribed time limit and shall be responsible for the legality and authenticity of the opinions on legitimate review.
第二十条 对规范性文件审查主要包括以下方面:
Article 20. The review of normative documents shall mainly include the following:
(一)执法主体是否合法;
(i) Whether the main body of administrative law enforcement is lawful or not;
(二)是否与现行法律、法规、规章及国家方针、政策相抵触;
(ii) Whether it is in conflict with existing laws, regulations, rules and national policies;
(三)涉及的行政许可、行政收费、行政处罚、行政强制等涉及公民、法人或其他组织的权利、义务的内容与依据是否合法、适当;
(iii) Whether its content regarding administrative license, administrative fee, administrative penalty and administrative compulsion etc. involved in the rights and obligations of citizens, legal persons or other organizations are legitimate and appropriate;
(四)是否有妨碍统一市场形成的地区封锁、行业垄断的内容;
(iv) Whether its content encompasses issues regarding regional blockade or trade monopoly that hinders the formation of the unified market;
(五)制定程序是否合法、规范;
(v) Whether the procedure of formulation is legitimate and standard;
(六)其他应当审查的内容。
(vi) Other contents that ought to be examined.
第二十一条 部门规范性文件草案经部门法制机构合法性审查后,必须经单位集体研究同意。
Article 21. After being examined in terms of the legality by the Legislative Affairs Office, the draft normative document shall be approved by the collective research of the organization.
第二十二条 两个或者两个以上部门联合发布的规范性文件,发布机关的法制机构均应进行合法性审查。
Article 22. For a normative document jointly issued by two or more organizations, the Legislative Affairs Office of every organization involved shall conduct a legitimate review.
第二十三条 政府或部门法制机构对规范性文件进行合法性审查,应当按照下列规定出具审查意见:
Article 23. The government or the Legislative Affairs Office shall put forward review opinions on the legality of normative documents in accordance with the following:
(一)规范性文件内容符合法律、法规和相关政策规定的,出具内容合法的意见;
(i) Where the contents of normative documents comply with relevant laws, regulations and policies, the opinions shall be issued legally;
(二)规范性文件部分内容不符合本办法第二十条规定的,出具建议修改的意见;
(ii) Where parts of the normative documents do not comply with the provisions of Article 20 of these measures, suggestions for amendment shall be issued;
(三)规范性文件主要内容不符合本办法第二十条规定的,出具不合法或重新起草后报送审查的意见。
(iii) Where the major contents of normative documents do not comply with the provisions of Article 20 of these measures, the opinions shall be issued as illegal or requiring for review after re-draft.
提请集体讨论或签发的规范性文件应当如实列明法制机构的审查意见。向法制机构发函征求意见,或者邀请法制机构参加座谈,法制机构的函复意见、会签或者在非正式活动上表达的意见,不属于合法性审查意见。
The normative documents submitted for collective discussion shall truthfully state the review opinions of Legislative Affairs Office. To send a letter to a Legislative Affairs Office for solicitation of opinions, or to invite the Legislative Affairs Office to participate in the panel discussion, the legislative affairs office’s replying letter, countersignature or the opinion expressed in informal activities do not constitute legal opinion on legitimate review.
第二十四条 因应对突发事件或者保障重大公共利益等紧急情况需要立即制定规范性文件的,经制定机关主要负责人批准,可以简化规范性文件制定程序。
Article 24. Where it is necessary to immediately formulate normative documents in response to emergencies, for instance, emergency safeguarding major public interests, the procedure for formulating normative documents may be simplified with the approval of the principal person in charge of the enacting organization.
第三章 公 布
Chapter 3. Announcement
第二十五条 县级政府的规范性文件可以采取政府令的形式公布。
Article 25. The normative documents of governments at county level may be published in the form of Government Decree.
部门规范性文件不得采取令的形式公布。
However, the department's normative documents shall not be published in the form of Government Decree.
第二十六条 规范性文件一般应当自公布之日起30日后施行。但因保障国家安全、重大公众利益等特殊需要的,可自公布之日起施行。
Article 26. The normative documents shall generally enter into full force 30 days after their publication. However, for the sake of special needs such as safeguarding national security and major public interests, some normative documents may come into full force as of the date of publication.
规范性文件一般不具有溯及力,但授益性的规范性文件除外。
The normative documents shall not have retrospective effects, except those benefits-rendering normative documents.
第二十七条 规范性文件制定后,应当采取适当方式向社会公布。未经公布的规范性文件不得执行。
Article 27. The normative documents, shall be published in the official gazette. Normative document that has not been published shall not be executed.
规范性文件应当在同级政府公报或门户网站上公布,也可以在报纸、公示栏等载体上公布。
The normative documents shall be published in the government bulletin or portal website at the same level, or in newspapers, bulletin boards and other channels.
市、县级人民政府在本级政府公报上公布的规范性文件是标准文本。
The normative documents published by the municipal and county-level people's governments in the government bulletin at the corresponding level are regarded as standard texts.
第二十八条 公众有权查阅已经公布的规范性文件。
Article 28. The public shall be allowed the right of access to published normative documents.
规范性文件制定机关应当在其门户网站、办公场所或市、县级政府指定的集中查阅场所提供本机关制定的规范性文件,供公众免费查阅。
The normative documents formulated by the authorities shall be provided to the public for free access at the portal websites, offices or centralized places for referring designated by the Municipal or county-level governments.
第四章 备 案
Chapter 4 Recordation
第二十九条 规范性文件按以下规定报送备案:
Article 29. The normative documents shall be submitted for record as follows:
(一)部门规范性文件于发布后15日内向同级政府报送备案;
(i) The department's normative documents shall be submitted to the government at the same level for record within 15 days after being released;
(二)乡(镇)以上政府规范性文件于发布后15日内向上一级政府报送备案。
(ii) The normative documents of the township (town) level government and above shall be submitted to the government at the next higher level for recording within 15 days after being released.
依照前款规定报送备案的,径送相关政府法制机构,由政府法制机构行使备案登记、审查职责。
Where the normative documents are submitted for record in accordance with the provisions of the preceding paragraph, they shall be directly delivered to the relevant government legislative affairs offices, which shall exercise the duty of recording, registration and review.
第三十条 两个或者两个以上部门联合发布的规范性文件由主办机关负责报送。
Article 30. The normative documents jointly issued by more than one department shall be submitted by the host organization.
国税、地税等实行垂直领导的行政机关制定的规范性文件,报上一级行政机关备案,报同级政府法制机构备查,法律、法规另有规定的除外。
The normative document formulated by administrative authority under vertical leadership, such as National Tax Bureau and Local Tax Authorities, shall be put on record by administrative authority at the next higher level, and shall be reported to the competent legal authority t at the same level for detailed investigation, unless otherwise stipulated by laws and regulations in force
部门代管的二级机构制定的规范性文件由代管机构报送备案审查。
The normative documents formulated by the entrusted secondary agency of the department shall be submitted for recording and review by the said agency.
第三十一条 规范性文件备案应当提交备案报告、文件文本、相关依据和制定说明,并按照规定格式一式两份装订成册,同时报送电子文档。
Article 31. For the recording of normative documents, the archival report, documents and texts, relevant basis and formulation instructions shall be submitted. Submissions shall be bound in two copies in the prescribed format and submitted electronically at the same time.
制定说明的要求按照本办法第十八条规定执行。
The requirement for the explanation of formulation shall be implemented in accordance with article 18 of these Measures.
报送省政府备案的市政府规范性文件,起草单位应当在规范性文件印发后5日内向市政府法制机构提交制定说明,由市政府法制机构向省政府报请备案。
If the formative documents are recorded by the provincial or regional government, the drafting departments shall submit the formulation explanations to the Legislative Affairs Office of the municipal government within 5 days after the issuance of formative documents, and then the Legislative Affairs Office of the municipal government shall report to the provincial or regional government for the record.
第三十二条 制定机关应当于每年1月31日前将上一年度制定的规范性文件目录一式两份报送受理备案的政府法制机构。
Article 32. The enacting authorities shall, before January 31 of each year, submit the list of normative documents formulated in the previous year in duplicate to the government legislative affairs offices for record.
第三十三条 规范性文件符合本办法第三十一条规定的,受理登记;不符合规定的,通知补充材料或者退回。在规定期限内不能补正备案材料的,视为没有报送备案,不予登记。
Article 33. Where the normative documents conform to the provisions of Article 31 of these Measures, registration shall be accepted. If the normative documents do not conform to these Measures, the submission will be notified as in need of supplementary materials or being rejected and returned. If the supplementary materials for record cannot be corrected within the prescribed time limit, they shall be deemed to have not been submitted for record and shall not be registered.
第三十四条 政府法制机构可以通过直接审查、委托审查等方式对规范性文件进行备案审查。
Article 34. the government Legislative Affairs Offices can conduct record and review of normative documents through direct or commissioned review.
直接审查、委托审查按照本办法第十九条的规定执行。
The direct review and commissioned review shall be carried out in accordance with Article 19 of these Measures.
第三十五条 政府法制机构对规范性文件进行备案审查时,需要制定机关提供相关材料或者说明有关情况的,制定机关应当在接到通知后3个工作日内报送材料或者说明情况;需要有关单位协助审查或者征求有关意见的,有关单位应当在规定时限内回复书面意见。
Article 35. Where it is necessary for an enacting authority to provide relevant materials or explain relevant information when a government Legislative Affairs Office conducts archival review of normative documents for record, the enacting authority shall submit the materials or explain the situation within 3 working days after receiving the notice. Where it is necessary for an organization concerned to assist in the review or solicitation of relevant opinions, the organization concerned shall reply with written opinions within the stipulated time frame.
第三十六条 规范性文件备案审查应当自受理登记后30日内完成。专业性比较强或者情况特殊的,可以延长审查期限,最长不得超过45日。
Article 36. The recording and review of normative documents shall be completed within 30 days after the acceptance of registration. If the review is highly professional or special, the review period may be extended to a maximum of 45 days.
第三十七条 备案审查中,发现报送备案的规范性文件存在违法或者不当情形的,政府法制机构应当向制定机关发出《纠错意见书》。
Article 37. In the process of archival review for record, if a violation or improper situation is found in the normative document submitted, the government legislative affairs office shall issue a letter of correction to the enacting organization.
第三十八条 制定机关应当自收到《纠错意见书》后10个工作日内自行改正,并书面回复办理结果。逾期不改正的,政府法制机构应当责令撤销或者报请本级人民政府予以撤销。
Article 38. The enacting authority shall correct itself within 10 working days after receiving the Letter of Correction and reply to the result in written form.
第三十九条 公民、法人或者其他组织在申请行政复议时对规范性文件提出审查申请的,或者行政复议机关在复议审查时认为有关规范性文件不合法的,依据《中华人民共和国行政复议法》第二十六条、第二十七条规定执行。
Article 39. If a physical or juridical person or any other organization applies for the review of a normative document to the Administrative Reconsideration Organisation, or if the Administrative Reconsideration organisation deems the relevant normative document illegal during reconsideration, the application shall be executed in accordance with the provisions of Articles 26 and 27 of Administrative Reconsideration Law of the People's Republic of China.
第四十条 公民、法人或者其他组织发现规范性文件与法律、法规和规章相抵触的,或者规范性文件之间存在矛盾的,可以向制定机关或者同级政府法制机构提出书面意见。
Article 40. If a physical or corporate person or any other organization finds that a normative document conflicts with current laws, regulations or rules, or that there is a contradiction between the normative documents, he may submit a written opinion to the enacting organization or the Legislative Affairs Office of the government at the corresponding level.
第四十一条 制定机关接到公民、法人或者其他组织对本机关制定的规范性文件提出质疑或者修改建议的,应当予以核实并在30日内答复建议人;规范性文件确有问题的,制定机关应当自行改正或者撤销。
Article 41. When the enacting authority receives a query or suggestion for amendment to the normative document formulated by a citizen, a legal person or any other organization, it shall verify it and reply to the proposer within 30 days. Where there are problems with the normative documents indeed, the enacting organization shall correct them or cancel them by itself.
政府法制机构接到公民、法人或者其他组织举报有关规范性文件存在问题的,转送制定机关核实处理,制定机关应当在规定时间内回复处理结果;必要时,政府法制机构可直接审查处理。
Where a government Legislative Affairs Office has received a complaint from a citizen, legal person or other organization about a problem with the relevant normative document, it shall transmit it to the enacting organization for verification and handling, and the enacting institution shall reply to the result within the prescribed time limit. When necessary, government legislative affairs offices may directly examine and deal with it.
公民、法人或者其他组织对制定机关的答复意见有异议的,应当在收到书面答复30日内提出复核建议。政府规范性文件向上一级政府法制机构提出,部门规范性文件向同级政府法制机构提出。接到复核建议的政府法制机构应当在30日内进行复核,并以适当方式反馈复核意见。
If a physical or juridical person or other organization has any objection to the reply of the enacting organization, it shall put forward a proposal for review within 30 days after receiving the written reply. The government's normative documents are put forward to the government's Legislative Affairs Offices at the next higher level, and the department's normative documents are put forward to the government's legislative affairs offices at the same level. The government Legislative Affairs Office that receives the review proposal shall conduct the review within 30 days, and feedback the review opinions in an appropriate manner.
第五章 清 理
Chapter 5. Cleaning up
第四十二条 规范性文件清理工作由制定机关负责,各级法制机构具体组织实施。
Article 42. The cleaning up of normative documents shall be undertaken by the enacting authorities, and shall be carried out by Legislative Affairs Offices at all levels.
市、县级政府法制机构至少每两年组织一次政府规范性文件全面清理;因法律法规或政策重大调整的,应当适时组织专项清理。
The Legislative Affairs Offices of municipal and county-level governments shall organize a comprehensive cleaning up of government normative documents at least every two years. In case of major adjustments of laws, regulations or policies, special cleaning up should be organized in due time.
全面清理和专项清理结果,一般采取公布保留规范性文件目录的方式,也可以将废止目录、宣布失效目录、修改目录一并公布。列入修改目录的规范性文件,应当明确修改完成期限,在规定期限内没有完成修改工作的,视为废止。
The results of comprehensive cleaning up and special cleaning up shall generally be published to preserve the catalogue of normative documents. Alternatively, the catalogue may be abolished, declared invalid and modified. A normative document included in the list of amendments shall be given a definite time limit for the completion of the revision. If the revision is not completed within the prescribed time limit, it shall be deemed to be abolished.
第四十三条 规范性文件实施机关应当根据法律、法规、规章的制定、修改、废止等情况以及经济社会发展需要,及时对本机关制定的规范性文件进行清理,并适时对执行的政府规范性文件提出清理意见。清理结果和清理意见径送同级政府法制机构。
Article 43. The authorities implementing normative documents shall, in accordance with the formulation, amendment and abolition of laws, regulations and rules as well as the needs of local economic and social development, promptly clean up the normative documents formulated by themselves, put forward the opinions on cleaning up the government's normative documents in due course. The results and opinions shall be sent to the government Legislative Affairs Offices at the same level directly.
规范性文件有效期届满前3个月,制定机关应当组织清理评估。政府规范性文件的清理评估,由实施部门组织,并提出废止、修改或继续实施的意见,经同级政府法制机构审查后,报同级人民政府决定。
The enacting authorities of normative documents shall organize evaluation of cleaning normative documents 3 months before expiry date of normative documents. The evaluation of cleaning up of government's normative documents shall be organized by the Implementing Department, which shall put forward suggestions on normative documents’ abolition, amendment or continuation. After the opinions are examined by the Legislative Affairs Offices of governments at the corresponding levels, the decision shall be made by people's governments at the corresponding levels.
第四十四条 制定机关应当按照下列规定对清理的规范性文件作出处理决定:
Article 44. The enacting authority shall make a decision on the handling of normative documents for cleaning in accordance with the following provisions:
(一)内容合法、仍然适用的,予以保留;保留的规范性文件可以延长有效期,但延长期最长不超过5年;
(i) The normative documents whose contents are legal and still applicable shall be retained. The validity period of these retained normative documents can be extended, not exceeding 5 years;
(二)内容与法律、法规、规章规定不一致或者不适当的,予以修订或者重新制定;
(ii) The normative documents whose contents are inconsistent or incoherent with current provisions of laws, regulations and rules will be revised or re-formulated;
(三)已被新的法律、法规或者规章等规定替代,有效期已过或者调整对象已消失的,予以宣布失效。
(iii) The normative documents that have been replaced by new laws, regulations, and that have expired or with disappeared objects, will be announced to be invalid.
Chapter 6. Supervision and Inspection
第四十五条 实行规范性文件报告制度。县(市、区)人民政府法制机构应当通过调阅、抽查制定机关发文登记簿和有关文件等方式,对规范性文件制定和备案情况进行监督检查,于每年第一季度向本级人民政府报告上一年度规范性文件制定、审查、备案情况,径送市人民政府法制机构。
Article 45. The normative reporting system shall be implemented. Legislative Affairs Offices at the people’s governments at county level (city and district levels) shall supervise and inspect the formulation and recording of normative documents by means of retrieval, selective review of formulating authorities’ registration list and so on. In the first quarter of each year, the Legislative Affairs Offices of the people's governments shall report to the people's governments at the corresponding level on the formulation, inspection and recording of the normative documents of the previous year, and shall submit them to the Legislative Affairs Office of the municipal people's government directly.
市政府法制机构应当在每年第二季度发布上年度规范性文件监督管理的通报。
The Legislative Affairs Office of the municipal government shall issue the notice on supervision and management of the normative documents of the previous year in the second quarter of each year.
第四十六条 有下列情形之一的,由负责备案审查的政府法制机构给予通报批评;情节严重的,由有权机关对相关责任人依法给予处分:
Article 46. In any of the following circumstances, the government Legislative Affairs Office responsible for the recording and review shall issue a notice of criticism If the circumstances are grave, the competent authority shall punish the person responsible according to the law:
(一)未按照规定制定公布规范性文件的;
(i) Failing to make and publish normative documents as required;
(二)未按照规定报送规范性文件备案的;
(ii) Failing to submit normative documents for recording as required;
(三)未按照规定报送政府规范性文件清理意见的;
(iii) Failing to submit opinions on clearing of normative documents to the government as required;
(四)拖延执行或者拒不执行负责备案审查的政府法制机构出具的备案审查意见的;
(iv) Delaying or refusing to implement in accordance with the record review opinions issued by the government Legislative Affairs Office responsible for it;
(五)未按照规定答复书面审查建议的。
(v) Failing to respond to the written review proposal as required.
第四十七条 法制机构违反本办法规定,有下列情形之一的,由制定机关给予通报批评;情节严重的,由有权机关对相关责任人依法给予处分:
Article 47. If a Legislative Affairs Office violates the provisions of these measures, it shall be criticized by the enacting authority in one of the following circumstances. If the circumstances are serious, the competent authority shall punish the person responsible according to the laws in force:
(一)未按照规定对规范性文件进行合法性审查的;
(i) Failing to examine the legality of normative documents as required;
(二)未按照规定对备案的规范性文件进行登记的;
(ii) Failing to register normative documents for recording as required;
(三)未按照规定对违法规范性文件进行纠正的。
(iii) Failing to correct illegal normative documents according to regulations.
第四十八条 市、县(市、区)人民政府及其法制机构可以根据本办法制定具体监督措施。
Article 48. The people’s governments at municipality and county level (city and district levels) together with their Legislative Affairs Offices may, in accordance with these Measures, formulate specific supervision measures.
第四十九条 本办法自2009年4月1日起施行。2001年5月14日公布的《邯郸市规范性文件制定程序若干规定》(邯政〔2001〕17号)、2003年6月13日公布的《邯郸市规范性文件备案管理办法》(市政府令第101号)、2006年4月12日公布的《邯郸市规范性文件时效评估制度规定》(〔2006〕22号)同时废止。
Article 49. These measures shall take effect from April 1, 2009. Provisions of Handan Municipality on Enacting Formula of the Normative Documents (HanZheng[2001]No.17) published on May 14, 2001, the Measures of Handan Municipality on the Record Management of Normative Documents (the Government decree No.101) published on June 13, 2003 and the Provisions of Handan Municipality on Effectiveness Evaluation System of Normative Documents ([2006]No.22) published on April 12, 2006 shall be repealed simultaneously.
