《邯郸市农村公路管理办法》已经2016125邯郸市人民政府第59次常务会议审议通过,现予公布,自201721日起施行。

The Measures of Handan Municipality on the Administration of Rural Roads which was adopted on the 59th executive meeting of Handan Municipal People’s Government of December 5, 2016, is hereby promulgated and shall come into force on February 1, 2017.

Measures of Handan Municipality on the Administration of Rural Roads

 

 

第一章     

Chapter 1   General

   

 

    第一条  为加强农村公路管理,保障农村公路完好畅通,为加强农村公路管理,保障农村公路完好畅通为加强农村公路管理,保障农村公路完好畅通,促进农村经济社会发展,根据《中华人民共和国公路法》、《公路安全保护条例》等有关法律法规的规定,结合我市实际,制定本办法。

Article 1  With a view to strengthening the administration of rural roads, guaranteeing the quality, mobility and accessibility of rural roads, and promoting the rural economic and social development. These Measures are formulated in accordance with the Highway Law of the People's Republic of China, the Highway Safety Protection Regulations, and other relevant laws and regulations, in the light of the actual circumstances of this Municipality.

第二条  我市行政区域内农村公路及其附属设施的规划、建设、养护和路政管理,适用本办法。

县级人民政府按县道等级要求进行管理的部分重要乡、村道路,其建设、养护和管理按县道管理标准执行。

Article 2  These Measures shall apply to the planning, construction, maintenance and administrative management of the rural roads as well as its attached equipment.

For some important township or village roads in the charge of County-level. People’s Government which are managed according to the county road level requirements, their construction, maintenance and management shall also be carried out according to the county road level requirements.

第三条  农村公路规划、建设、养护和路政管理遵循政府主导、分级负责、全面规划、规范建设、有路必养、依法管理的原则。

Article 3  The planning, construction, maintenance and the administrative management follow the principle of government leading, hierarchical responsibility, comprehensive planning, standardized construction, paying attention to maintenance and management by law.

第四条  市、县级人民政府把农村公路建设和发展纳入国民经济和社会发展规划,逐步加大对农村公路的资金投入,促进农村公路持续健康发展

Article 4  As a part of the national economic and social development program, the people’s governments of the Municipality and counties shall gradually increase investment in rural roads and promote sustainable development of the rural roads.

第五条  市人民政府组织指导、监督全市农村公路规划、建设、养护和路政管理工作,其交通运输主管部门农村公路管理机构负责业务指导、协调、督导、检查、考核等具体工作。

县级人民政府为本行政区域农村公路规划、建设、养护和路政管理的责任主体,其交通运输主管部门农村公路管理机构具体负责农村公路规划和县道建设、养护及县道、乡道路政管理工作。

乡(镇)人民政府在县级人民政府确定的职责范围内,负责乡、村道路建设、养护和管理工作;村民委员会在当地人民政府和交通运输主管部门指导帮助下,做好本村村道建设和养护工作。

Article 5  Handan Municipal People’s Government is responsible for directing and supervising the planning, construction, maintenance and administrative management of rural roads in the Municipality. The rural road management agency of transportation department attached to the municipal government is responsible for guidance, coordination, supervision, inspection, assessment and some other specific work.

The county-level people’s government is responsible for directing and supervising the planning, construction, maintenance and administrative management of rural roads in its administrative region. Rural road management agency of transportation department attached to the county-level government is responsible for the planning of rural roads, construction and maintenance of county roads and the administrative management of county roads and township roads.

Township (Town) People’s Government is responsible for the construction, maintenance and administrative management of township roads within the scope of the functions defined by the people's governments at the county level.

第六条  市、县、乡级人民政府应当根据农村公路管养里程和管理工作需要,完善市、县、乡(镇)农村公路管理体制机制配备专业技术及管理人员,归口负责农村公路规划、建设、养护和路政管理工作,其人员和工作经费纳入本级人民政府公共财政预算。

Article 6  The People’s Government at the levels of the Municipality, county and township should improve the rural road management system of the Municipality, county, township (town), equip rural roads with professional technical and management personnel who are responsible for the planning, construction, maintenance and administrative management, in accordance with the actual needs of managing, maintaining the rural roads. Its personnel and work funds will be included into the public budget of the people's government at the corresponding level.

第七条  市、县级交通运输主管部门应当畅通农村公路工作投诉举报渠道,公布投诉举报电话,接受社会各界的监督,并督促责任单位及时处理。

Article 7  The Municipality and county transportation departments should smoothen the channel for complaints respecting rural roads work, make the compliant number known to the public, accepts the supervision from all walks of life and urge the responsible units to take timely action.

第八条  市、县级发展改革、财政、规划、建设、国土资源、环境保护、农牧、水利、林业、审计、公安、安全监管等部门,按照各自的职责做好农村公路相关工作。

Article 8   Other relevant departments at the Municipal and county level like development and reform, finance, planning, construction, land and resources, environmental protection, agriculture and animal husbandry, water conservancy, forestry, auditing, public security, safety supervision etc. shall do a good job of related work in accordance with their own duties.

 

第二章  农村公路规划

Chapter 2  Planning of the Rural Roads

第九条  农村公路规划应当根据本行政区域国民经济和社会发展规划土地利用总体规划、环境保护规划及人民群众生产生活、农业生态环境的实际编制,与国道、省道发展规划及交通运输发展规划相协调,与城乡规划相衔接。

Article 9  The planning of the rural roads should be formulated in the light of economic and social development plan, overall land use planning, environmental protection planning, the production and daily life, and the agricultural ecological environment in this administrative region, should be coordinated with development plan of national and provincial highway and the transportation system, and should be aligned with urban and rural planning.

第十条  农村公路规划应当对人民群众需求迫切、社会资本充足、地方经济发展具有重大影响的道路,提高等级、优先安排。

Article 10  The rural roads which are in urgent need, have adequate social capital and have significant impact on the local economic development should be improved to a higher level and given priority arrangement in the process of planning.

第十一条  市交通运输主管部门根据国家和省农村公路发展目标,指导编制市、县级农村公路发展规划。

县道规划由县级交通运输主管部门会同有关部门编制,经县级人民政府审定,报市人民政府批准。乡道、村道规划由县级交通运输主管部门协助乡(镇)人民政府编制,由县级人民政府批准,按程序纳入全省公路数据库后执行。

编制村道规划应当听取沿线村民委员会的意见。

县道、乡道规划,应当报批准机关的上一级人民政府交通运输主管部门备案。

经批准的农村公路规划需要修改的,由原编制机关提出修改方案,并按原程序报批备案。

    Article 11  The Municipal Department of transportation shall guide the establishment of rural road development plan at the Municipal and county level in accordance with the national and provincial rural roads development goals.

The planning of county roads is made by the competent department of transportation at county level together with relevant departments, is examined by the county people’s government and is finally approved by the municipal government. The planning of township and village roads is made by the township (town) people’s government with the help of competent department of transportation at county level, is approved by the county people’s government and will be carried out after being included in the highway database.

When planning the village’s roads, the department shall draw advice from the villagers’ committee along the road.

The planning of the county and township road should be reported to the transportation department of people’s government at the higher level of the authorities for approval.

 

第三章  农村公路建设

Chapter 3   The Construction of Rural Roads

第十二条  农村公路建设应当坚持保护耕地和生态环境、节约用地的原则,与生态保护同步进行,防止水土流失和环境污染

农村公路安全防护设施、排水设施以及农村公路绿化、美化、文化设施等,应当与农村公路主体工程同步设计、同步施工、同步投入使用。

Article 12  The construction of rural roads should stick to the principle of protecting cultivated land, protecting ecological environment and saving land, should be simultaneous with ecological protection, and prevent soil erosion and environmental pollution.

第十三条  列入新改建计划的农村公路应当执行以下建设标准:

(一)县道:一般不低于二级路标准、路面宽度不低于9

(二)乡道:一般不低于三级路标准、路面宽度不低于7

(三)村道:一般不低于四级路标准、路面宽度不低于5

条件不具备的山区路段和因地形地貌受限的局部平原路段,可适当降低标准。

Article 13  The rural roads under the new plan shall meet the following construction standards:

(1) County road: generally, not less than Level II road standards, road width of not less than 9 meters.

(2) Township road: generally, not less than Level III road standards, road width of not less than 7 meters.

(3) Village road: generally, not less than Level IV road standards, road width of not less than 5 meters.

If there are some mountain roads or local plain roads limited by topographic features which fail to meet the above requirements, standards can be lower for them.

第十四条  农村公路建设计划采用项目库管理。

县道建设由县级交通运输主管部门农村公路管理机构担任项目法人;乡道、村道建设由乡(镇)人民政府担任项目法人。乡(镇)人民政府无力承担项目法人职责的,可以委托县级交通运输主管部门农村公路管理机构担任项目法人。

项目法人组织对拟建设的农村公路项目编制工程可行性研究报告(或建设方案),由县级交通运输主管部门出具审查意见,报县级发展改革部门审批。项目法人按照工程可行性研究报告批复编制施工图设计(或设计方案),报县级交通运输主管部门审批,列入农村公路建设项目库。

Article 14  The rural roads construction project takes project library management.

The legal person of county road construction is rural road management agency of transportation department at county level. The legal person of township and village road construction is country (town) people’s government. Country (town) people’s government can entrust the rural road management agency of transportation department as the legal person of the project if people’s government is unable to undertake the duties.

The legal person is responsible for making a feasibility study report (or construction plan) of rural road project. The transportation department will examine the report and come up with some opinions, and then it will be reported to the development and reform department at county level for examination and approval. The legal person of the project will approve the construction plans (or design) in accordance with project feasibility study report, and then transportation department at county level will examine and approve it and finally include it in the rural road construction project library.

第十五条  县级人民政府配套资金筹集到位的入库项目,由县级交通运输主管部门报市交通运输主管部门列入年度农村公路建设计划,纳入国家、省补助范围。

Article 15  The projects to be included in the library whose funds are raised by county people’s government, will be reported to municipal transportation department by the county transportation department and be included in the annual rural road construction plans, which accept the national and provincial subsidies.

第十六条  经批准的农村公路建设计划,不得随意变更。确需调整的,应当报请县级人民政府同意后调整至同类性质项目,并将项目调整情况报市交通运输主管部门备案。

Article 16  The approved plan of rural road construction cannot be changed randomly. The projects, which need adjustment indeed, shall be submitted to the people's government at the county level to adjust to the similar nature of the project, and the adjustment will be reported to the transportation department for record.

第十七条  农村公路建设用地由县级人民政府负责。

因农村公路建设和养护需要占用国有荒山、荒地时,按土地转用相关规定报经有批准权限的人民政府批准后,由县级人民政府无偿划拨县级公路需要占用集体土地的,应按照相关规定履行土地转用征收报批程序;乡、村公路需占用集体土地的,可以按乡(镇)村公共设施和公益事业,办理土地转用手续后建设使用。在划拔或批准用地范围内可以挖沙、采石、取土,任何单位和个人不得阻挠或违法收取费用,在河道管理范围内的,按有关规定执行。

Article 17  The county people’s government is responsible for the land for rural road construction.

When there is a need of state-owned barren hills and wasteland because of the rural road construction and maintenance, payment will be transferred gratuitously by county people’s government if the application is reported to and approved by the people's government with approval authority, which is in accordance with the provisions related to land conversion.

第十八条  农村公路建设按照规定的建设程序执行。达到法定招标规模的,应当依法进行招标。

Article 18  Rural road construction should be carried out in accordance with the regulated construction procedures. There will be a legal tender biding if the projects reaches the scale of legal tender.

第十九条  县道的施工许可,由市交通运输主管部门批准;乡道、村道的施工许可,由县级交通运输主管部门批准。

Article 19  The permission of county road construction will be given by the municipal transportation department; the permission of township and village roads construction will be given by the county level transportation department.

第二十条  农村公路建设项目应当对建设单位、设计单位、施工单位、监理单位、质量监督单位以及建设计划、资金使用和工程质量情况等进行现场公开。

鼓励村民代表、社会人士担任义务监督员,参与监督工作。

Article 20   The basic information of rural road construction project should be announced to the public on the site like the development unit, design unit, construction unit, construction control unit, quality control unit and the construction plan, use of funds, and the quality of project etc.

第二十一条  农村公路建设项目应当建立安全生产责任制和工程质量责任追究制农村公路建设、施工和监理单位应当依据职责,明确安全、质量管理责任,落实安全、质量保证措施,加强安全与质量管理。

Article 21  The rural highway construction project shall establish accountability system of production safety and project quality. The development unit, construction unit and construction control unit of rural road construction project should make the safety and management responsibility clear, implement safety and quality assurance measures, and strengthen safety and quality management in accordance with their own duties and responsibilities.

第二十二条  农村公路建设资金主要来源为省级补助、市级奖励补助和县级配套市级奖励补助标准为县乡道二级公路一般每公里不低于500000元,三级公路一般每公里不低于200000元,村道路面宽度大于等于5的一般每公里不低于50000

农村公路建设资金依据工程进度和合同文件进行计量支付。

Article 22  The funds for rural road construction come from the Provincial subsidies, municipal rewards and subsidies and county level counterpart funding. Standard for municipal rewards and subsidies is: Level II county road is generally not less than 500000 CNY, Level III county road is generally not less than 200000 CNY and the village road width is greater than or equal to 5 meters per kilometer is generally not less than 50000 CNY.

第二十三条  农村公路建设项目交、竣工验收可合并进行。县道由县级交通运输主管部门向市交通运输主管部门提出申请,由市交通运输主管部门农村公路管理机构牵头,组织有关部门进行验收;乡、村道路由县级交通运输主管部门牵头,组织有关部门进行验收。

未经验收或者验收不合格的农村公路建设项目,不得交付使用。

Article 23  The project checking and completion accepting of rural road construction can be combined and be carried out simultaneously. Checking and acceptance of county roads will be led by rural road management agency of municipal transportation department and will be carried out by other relevant departments organized by the rural road management agency. Checking and acceptance of township and village roads will be led by rural road management agency of county transportation department and will be carried out by other relevant departments organized by the rural road management agency.

 

第四章  农村公路养护

Chapter 4 Maintenance of the Rural Roads

第二十四条  农村公路养护应当遵循预防为主、防治结合、全面养护、保障畅通的原则,加强地质灾害巡查保持路基边坡稳定、路面整洁、排水畅通、交通标线完整、构造物及沿线附属设施完好安全防护设施符合规范,保证公路正常使用。

Article 24  The maintenance of rural road should follow the principles of prevention first, combination of prevention and cure, comprehensive maintenance and ensuring unimpeded, should strengthen geological hazard inspection, should keep the sub-grade slope stable, surface clean, drainage smooth, traffic marking complete, structures and ancillary facilities along the line intact, and safety protection facilities legal, so that the normal use of rural road can be ensured.

第二十五条  农村公路养护实行专业养护与群众养护、日常养护与集中养护等多种养护方式相结合,逐步实现以专业养护为主。农村公路养护逐步引入市场机制,鼓励面向社会公开招标,择优选定具备资格条件的养护单位推进农村公路养护专业化

Article 25  The way of rural road maintenance is a combination of diverse maintenance manners, like a combination of professional maintenance and the masses maintenance, and a combination of daily maintenance and centralized maintenance, thus gradually reaches the goal of putting professional maintenance as the main. Market mechanisms will be gradually introduced to the rural road maintenance. Relevant departments encourage public tendering, select the qualified maintenance unit and promote the rural road maintenance specialization.

第二十六条  县级交通运输主管部门农村公路管理机构应当按照农村公路养护资金总量编制年度农村公路养护计划,报县级人民政府批准,并将批准文件报市交通运输主管部门农村公路管理机构备案.

Article 26  The rural road management agency of county transportation department should produce an annual plan of maintaining the rural roads in accordance with the total amount of rural road maintenance funds, which will be reported to the county people’s government for approval. The approval document should also be reported to the rural road management agency of municipal transportation department for record.

第二十七条  农村公路日常养护包括日常清扫、保洁和排雨除雪、保障畅通等,资金来源为县级人民政府财政预算列支的农村公路日常养护经费养护经费不低于以下标准:县道每年每公里20000元、乡道每年每公里10000元、村道每年每公里5000元,大桥每年每座10000元、中桥每年每座5000元、小桥每年每座2000元。

农村公路养护工程包括路面稀浆封层、沥青灌缝、坑槽挖补、路肩培护、边坡整修、田路分家、路树补植、安全和防护设施完善等,资金来源为省级定额农村公路养护工程补助资金、省级农村公路养护“以奖代补”专项资金、市级定额农村公路养护工程补助资金、县级农村公路养护工程配套资金。其中,市级定额农村公路养护工程奖励补助资金标准为不低于县道每年每公里10000元、乡道每年每公里5000元、村道每年每公里2000元。

Article 27  The daily maintenance of rural road includes daily cleaning, clean-keeping, drainage of rain and snow and ensuring smooth flow etc., whose capital is from the rural road daily maintenance funds of county People's government budget expenditure. Maintenance funds shall not be less than the following standards: county road 20000 CNY per kilometer per year, township road 10000 CNY per kilometer per year, village road 5000 CNY per kilometer per year, major bridge 10000 CNY per kilometer per year, medium bridge 5000 CNY per kilometer per year, minor bridge 2000 CNY per kilometer per year.

The maintenance project of rural road includes pavement slurry seal, asphalt grouting, pit patching, hard shoulder cultivation, slope renovation, the separation of farmland and road and perfecting safety and protection facilities etc., whose capital is from the provincial rural highway maintenance quota subsidies,  the provincial special funds of “replacing subsidies with rewards” of rural road, Municipal quota subsidies for rural highway maintenance project , County level rural highway maintenance project funds. Also, criteria of Municipal quota subsidies for rural highway maintenance project is not less than 10000 CNY per kilometer per year for county road, not less than 5000 CNY per kilometer per year for township road and not less than 2000 CNY per kilometer per year for village road.

    第二十八条  县级交通运输主管部门农村公路管理机构应当加强对农村公路养护计划实施的管理,达到法定招标规模的养护工程,应当依法进行招标。

农村公路养护作业时应当严格执行国家规定的技术规范、操作规程,并按照规定设置安全警示标志。

Article 28  The Rural road management agency county transportation department shall ensure the management of carrying out rural road maintenance plan. Tendering should be held when the maintenance project reaches the scale of legal tender.

Rural road maintenance work should be strictly enforced by the state technical specifications, operating procedures, and setting safety warning signs in accordance with the provisions.

第二十九条  农村公路养护质量标准与要求:

(一)农村公路用地范围内无垃圾、杂物、残垣断壁,实现田路分家、宅路分家;

(二)路基坚实稳定,路肩平整,与路面接茬平顺,边缘顺直;

(三)边坡稳定、坚固、平顺,坡度符合规定

(四)边沟、排水沟无淤塞、排水通畅,防护设施完好、无破损;对边沟同属水利部门管理的渠道部分,满足水利功能;

(五)路面平整完好、清洁无杂物、横坡适度、排水畅通、具有足够的强度;

(六)及时修补沥青路面的裂缝和坑槽,及时填灌水泥混凝土路面的裂缝和纵横接缝;

(七)桥梁桥面铺装平整无裂缝、桥头无跳车、排水通畅无堵塞、桥面清洁无杂物;涵洞完好无淤塞、无开裂、无沉陷、八字翼墙完整、坚固;

(八)宜林路段因地制宜进行绿化。及时对路树进行修剪、定期刷白、防治病虫害,保障路树正常生长。

Article 29  The quality standards and requirements of rural road maintenance

(1) There is no garbage, debris and ruins within the scope of rural road, realizing the separation of farmland and road, and the separation of houses and road.

(2)The roadbed is solid and stable, and the hard shoulder of road is flat, which is with a straight edge and is connected smoothly with road.

(3) The side slope is stable, firm and smooth, and the slope is complied with the regulations.

(4) There is no blockage in side ditch and drainage ditch and drainage goes smoothly; protective facilities are intact;

 

(5) The road surface is smooth, clean and free of rubbish, the cross slope is moderate, the drainage is smooth, and has enough strength;

(6) To repair the cracks and pits on the asphalt pavement and to timely fill the vertical and horizontal crack joints of cement concrete pavement.

(7) There is no cracks on the bridge deck pavement, no jumping on the bridgehead, no obstruction in the drainage and no rubbish on the bridge. There is no blockage, no cracking, no subsidence in the culvert and the wing wall is intact and firm.

(8) To carry out afforestation on the roads that are suitable for planting trees. The trees along the road need to be pruned, whitened, conducted pest control regularly, in order to guarantee the normal growth of trees.

第三十条  县级交通运输主管部门农村公路管理机构应当建立健全公路管理档案,对公路、公路用地、公路附属设施调查核实、登记造册。

Article 30  The Rural road management agency of county transportation department should establish and perfect the management archives of rural road, and investigate, check and record the rural roads, road land and the attached equipment information.

第三十一条  县级人民政府建立农村公路安全协调机制并制定应急预案,及时处置自然灾害或者其它突发事件,保障农村公路安全畅通。农村公路中断或者严重损坏的,县、乡(镇)人民政府应当及时修复。

Article 31  The people's governments at the county level shall establish a safety coordination mechanism for rural roads and make emergency plans to deal with natural disasters or other emergencies in a timely manner, so as to ensure the safe and smooth operation of rural roads. In case of interruption or serious damage to the rural roads, the people's governments of counties and townships (towns) shall carry out timely repair.

第三十二条  负责农村公路日常养护的单位或个人应当按合同规定对农村公路进行定期巡查,发现突发损坏、交通中断或者路产路权案件等影响公路运行的情况时,及时按有关规定处理和上报。县、乡级农村公路管理机构应当按要求对农村公路养护工作进行督促和抽查,其中县道由县级交通运输主管部门农村公路管理机构负责,乡道、村道由乡级人民政府农村公路管理机构负责。

Article 32  The Units or individuals responsible for the daily maintenance of rural roads should be carried out regular inspection according to the provisions of the contract, which should adopt treatment and report to the superior in accordance with the relevant provisions once some accidents that may influence the normal operation of rural road, like sudden damage, traffic disruption and cases related to road property and road rights. County and Township rural road management organizations shall conduct supervision and inspection on the rural highway maintenance work. Rural road management agency of county transportation is responsible for the supervision and inspection of county roads and rural road management agency of township transportation is responsible for the supervision and inspection of township and village roads.

第三十三条  大型建设项目在施工期间需要使用农村公路的,应当按照指定线路行驶,符合荷载标准。对公路造成损坏的应当进行修复或者依法赔偿。

Article 33  The vehicles of large construction projects, which have to use the rural roads, should run in the specified route and meet the load standards. Those who damage the roads will repair it or compensated by law.

 

第五章  路政管理

Chapter 5  Administrative Management of Rural Road

第三十四条  县级人民政府安排农村公路路政管理专项经费,专项用于农村公路路政管理队伍日常管理、设施建设、装备配备、治超站点建设等。

Article 34  The people’s government at county level will arrange special funds for rural road administrative management, which is for daily management of rural road administrative team, facility construction, equipment construction and dispelling overload station construction.

第三十五条  农村公路建筑控制区的范围从公路用地外缘起向外的距离标准为:

(一)县道不少于10;

(二)乡道不少于5;

(三)村道不少于3

农村公路建筑控制区内除公路保护需要外,禁止修建建筑物和地面构筑物。

建筑控制区划定前已经合法修建的,不得扩建,因公路建设或者保障公路运行安全等原因确需拆除的,依法给予补偿。

Article 35  The scope of rural road construction control area is, starting from road land edge of an outward distance of:

(1) not less than 10 meters for county road;

(2) not less than 5 meters for township road;

(3) not less than 3 meters for village road.

第三十六条 在农村公路、农村公路用地范围内禁止下列行为:

(一)进行集市贸易、摆摊设点;

(二)打场晒粮、堆放物料、种植作物、放养牲畜;

(三)挖沟引水、漫路灌溉、采石取土;

(四)撒漏污物、倾倒垃圾、焚烧物品、堵塞边沟;

(五)损坏、破坏桥梁护栏、栏杆扶手,移动、涂改农村公路附属设施;

(六)擅自架设、埋设管道、电缆;

(七)擅自设置公路标志以外的其他标志;

(八)擅自更新采伐树木;

(九)其他损坏、破坏、污染、非法占用或者非法利用农村公路、公路用地和公路附属设施以及影响农村公路完好、安全、畅通的。

有前款行为,对农村公路造成损失的,应当依法予以补偿或者赔偿。

Article 36  The following behaviors are prohibited on the rural road and within the scope of rural road land;

(1) To trade and set up store

(2) To dry grain, stock goods, grow crops, and stock cattle.

(3) To trench and take water, to carry out diffuse road irrigation, to quarry.

(4) To spread the contamination, dump the garbage, burn refuge and block the edge channel.

(5) To damage the bridge guardrail and railing, and to move or alter the rural road affiliated facilities;

(6) To erect and lay pipelines and cables without authorization

(7) To set up other signs other than road signs without authorization

(8) To cut trees without authorization

(9) Other damage, destruction, pollution, illegal occupation or illegal use of rural roads, road land and road ancillary facilities and other behaviors that affect the road being in good, safe and smooth condition.

第三十七条 超过农村公路、桥梁、隧道限载、限高、限宽、限长标准的车辆和履带车等可能损害农村公路的车辆,不得在公路上行驶(农业机械因当地田间作业需要在公路短距离行驶的情形除外)。确需行驶的,应当经县级交通运输主管部门农村公路管理机构批准并采取有效防护措施。对农村公路造成损害的,应当给予相应补偿。

县级交通运输主管部门农村公路管理机构可根据需要,按国家有关规定设置农村公路超限检测站。

Article 37  The vehicles that exceed the load, height, width and length limit of rural roads, bridges and tunnels, and which may damage the rural roads like crawler vehicle are not allowed to travel on the rural road (except for the agricultural machinery required for local field operations in a short distance). Where it is necessary to drive, it shall be subjected to the approval of the rural highway administrative authority at the county level and the effective prevention measures. Those who cause damage to rural roads shall be compensated accordingly.

Rural road management agency of transportation department at county level can set up rural road overrun detection station in accordance with the relevant provisions and in the light of actual need.

第三十八条 临时占用、挖掘农村公路或者从事其他涉路项目作业的,应当经县级交通运输主管部门农村公路管理机构批准后方可施工。影响交通安全的,还应当征得公安机关交通管理部门同意。工程完工后,应当按照原技术标准予以修复或者承担修复费用。

Article 38  Projects relevant to the rural roads like temporarily occupying, excavating rural roads should be approved by the rural road management agency of county transportation department first before construction. Projects that may affect the traffic safety should also be approved by the traffic management department of public security organization. After the completion of the project, the road should be repaired with the original technique or it should bear the cost of repairing.

第三十九条  县级公安交通管理部门在处理农村公路交通事故时,如涉及农村公路及其附属设施损坏的,应当及时通知县级交通运输主管部门农村公路管理机构查验损失。

Article 39  Public security transportation management department at county level should announce rural road management agency of county transportation department to check the loss when dealing with the rural road traffic accidents involving the damage of rural road and its Ancillary facilities.

第四十条  县级人民政府交通主管部门或乡(镇)人民政府可以根据保护乡道、村道的需要,在乡道、村道的出入口设置必要的限高、限宽设施,但不得影响消防和卫生急救等应急通行需要,其他任何单位和个人不得在乡道、村道上设置障碍物。

Article 40  The competent department of transportation of county people’s government can set up the necessary height and width limit facilities in the light of the actual need of protecting township roads and village roads. However, it cannot influence the fire, medical and other emergency need to pass. Any other units or individuals cannot set any obstacles on the township road or village road.

 

第六章     

Chapter 6 Assessment

第四十一条  市人民政府将农村公路管理工作纳入对县级人民政府考核范围,具体办法由市考核主管部门会同市交通运输主管部门另行制定。

县级人民政府应当将农村公路管理工作纳入对乡(镇)人民政府考核范围,并根据考核结果进行奖惩。

Article 41  The Municipal People's Government shall incorporate the administration and management of rural roads as a part of assessment of the people's governments at the county level, and the specific measures shall be formulated separately by the municipal administrative department in charge of examination and approval together with the municipal transportation department.

The people's governments at the county level shall incorporate the administration and management of rural roads as a part of assessment of the people's governments of townships (towns), and shall reward and punish them according to the results.

第四十二条  农村公路管理工作主要考核内容为

(一)县、乡农村公路管理机构建设情况;

(二)县、乡人民政府农村公路资金到位情况;

(三)农村公路建设计划完成情况;

(四)农村公路养护效果情况;

(五)农村公路路政管理情况。

考核结果作为市级奖补资金拨付的重要依据。

Article 42  The assessment content of rural road administrative management includes:

(1) The construction of rural road management agency at county and township level;

(2) The availability of funds for rural roads of the county and township people’s governments;

(3) The completion of rural road construction plan;

(4) The effect of rural road maintenance;

(5) The situation of administrative management of rural roads.

The assessment results will be viewed as an important basis for municipal prize funds allocation.

     

第七章  法律责任

Chapter 7 Legal Responsibility

第四十三条  在农村公路建筑控制区内修建建筑物和地面构筑物或者擅自埋设管线、电缆等设施的,根据《公路安全保护条例》第五十六条的规定,由县级交通运输主管部门农村公路管理机构责令限期拆除,可以处以50000元以下罚款。逾期不拆除的,由县级交通运输主管部门农村公路管理机构拆除,有关费用由违法行为人承担。

Article 43  Those who construct buildings or ground structures in the rural road construction control area, or lay pipelines, cables and other facilities without authorization, will be commanded demolition by the rural road management agency of county transportation department with a time limit, and will be imposed a fine of less than 50000 CNY in accordance with the article 56 of Regulations Governing Management of Highways in the PRC. Those which are not removed within the prescribed time limit, shall be demolished by the rural road management agency of county road transportation department, and the relevant expenses shall be borne by the illegal party.

第四十四条  违反本办法第三十六条第(一)、(二)、(三)、(四)、(九)项或者第四十条的规定,损坏、破坏、污染、非法占用或者非法利用农村公路、公路用地和公路附属设施以及影响公路完好、安全、畅通的,由县级交通运输主管部门农村公路管理机构责令停止违法行为,可以处5000元以下罚款。

Article 44  Those who violate article 36 (1)(2)(3)(4)(9) or article 40 of the measures, damaging, destructing, polluting, occupying or using illegally the rural road, rural road land, or road ancillary facilities, or affecting the road being in good, safe and smooth condition, will be commanded stopping illegal behaviors and be imposed a fine of less than 5000 CNY by the rural road management agency of county transportation department.

第四十五条  违反本办法第三十六条第(七)项规定,在农村公路用地范围内设置公路标志以外其他标志的,根据《中华人民共和国公路法》第七十九条的规定,由县级交通运输主管部门责令限期拆除,可以处20000元以下罚款;逾期不拆除的,由县级交通运输主管部门农村公路管理机构拆除,有关费用由设置者承担。

Article 45  Those who violate article 36 (7), setting up other signs other than road signs within the scope of rural road land without authorization, will be commanded dismantling and may be imposed a fine less than 20000 CNY by the rural road management agency of county transportation department. If it is not removed within the prescribed time limit, it will be dismantled by the rural road management agency of county transportation department, and the relevant expense shall be borne by the violator.

第四十六条  违反本办法第三十六条第(八)项规定,未经批准更新采伐农村公路用地范围内林木的,根据《公路安全保护条例》第六十一条的规定,由县级交通运输主管部门农村公路管理机构责令补种,没收违法所得,并处采伐林木价值3倍以上5倍以下罚款。

Article 46  Those who violate article 36 (8), cutting trees within the scope of rural road land without authorization, will be commanded by planting new trees to supplement the rural road management agency of county transportation department, and be imposed a fine of more than 3 times less than 5 times as much as the value of trees cut and the illegal income will be confiscated, in accordance with the article 61 of Regulations on protecting highway safety.

第四十七条  违反本办法规定,有下列行为之一的,根据《公路安全保护条例》有关规定,由县级交通运输主管部门农村公路管理机构责令停止违法行为,可以处30000元以下罚款:

(一)损坏、擅自挪动标桩、界桩的;

(二)擅自占用、挖掘农村公路或者从事其他涉路项目作业的;

(三)擅自在农村公路上超限行驶的;

(四)损坏、破坏桥梁护栏、栏杆扶手,移动、涂改农村公路附属设施的。

Article 47  Those who violate this article, having one of the following behaviors, will be commanded stopping illegal behaviors and be imposed a fine of less than 30000 CNY by the rural road management agency of county transportation department In accordance with Regulations on protecting highway safety.

(1) To damage or move signs or boundary markers without authorization

(2) To occupy, excavate the rural roads or carry out other road related projects without authorization

(3) To drive on the rural road exceeding the limit without authorization

(4) To damage, destruct the bridge guardrail and railing, and to move or alter the rural road affiliated facilities;

 

第八章     

Chapter 8   Annex

第四十八条  本办法所称农村公路,是指纳入河北省公路数据库统计并符合规定建设标准的县道、乡道和村道,包括农村公路桥梁、隧道、涵洞和附属设施。未纳入河北省公路数据库统计的其它农村公路,可参照本办法进行管理。

Article 48  The rural roads mentioned in the measure refer to all the county roads, township roads and village roads which are included into the road database of Hebei Province and meet the relevant construction requirements, including rural road bridges, tunnels, culverts and ancillary facilities. Other rural roads that failed to be included into the road database of Hebei Province can be managed referencing to the measures.

第四十九条  县级人民政府可根据本办法制定实施细则。

Article 49  The people’s government at county level can formulate detailed rules for implementation in accordance with the measures.

第五十条  本办法自2017 21日起施行。

Article 50  The measures will come into force on February 1st, 2017.
