The Measures of Handan Municipality on Carwash Administration which has been adopted at the 57th executive meeting of Handan Municipal People’s Government on October 8, 2016, is hereby promulgated and shall come into force on December 1, 2016.

Measures of
第一条 为了加强城市市容和环境卫生管理，规范机动车车辆清洗经营活动，保持机动车车辆车容整洁，根据国务院《城市市容和环境卫生管理条例》、《邯郸市城市市容和环境卫生条例》等有关规定，制定本办法。
Article 1 The Measures are formulated in accordance with the Regulations for Administration of Urban Appearance and Environment Sanitation issued by the State Council and the Measures of Handan Municipality on Appearance and Environmental Sanitation in light of the specific situation of this municipality, and for the purpose of strengthening the supervision of the urban appearance and environment, standardizing the operating activities of carwash, and keeping vehicles clean.
第二条 本办法适用于本市下列区域内机动车洗车场的设置、经营及监督管理活动，具体区域包括：
（一）中心城区及其他县级人民政府所在地城区；
（二）镇人民政府所在地建成区；
（三）工业集中发展区、农村新型社区等其他实行城市化管理的区域，其范围由县（市、区）人民政府划定、公布。
Article 2 The Measures shall apply to management activities in the setup, operation and supervision of carwash for motor vehicles in the following areas of the city and the specific areas include:
(1) The central district of
(2) The established locations of the town people’s governments;
(3) The industry concentrated development zones, new type of rural village communities and other areas under urbanization management, the scopes of which are allocated and announced to public by the people’s governments of the county (city, districts).
第三条 本办法所称机动车洗车场，是指具备固定经营场地、配有与其规模相适应的洗车保洁设备及洗车用水、排水、污水处理等设施设备，从事机动车清洗保洁活动的场所。
Article 3 For the purposes of these Measures, “carwash” means that a business site engages in the activities of cleaning and washing motor vehicles with a fixed location of business, an appropriate scale of equipments for car washing, and a associated waste-water treatment facility for water supply, drainage and sewage.
第四条 市城市管理行政主管部门是全市机动车洗车行业的主管部门，其所属的机动车洗车场管理机构具体负责市主城区机动车洗车场的日常监督、管理工作。
县（市、区）城市管理行政主管部门负责本行政区域内机动车洗车场的监督、管理工作。
规划、建设、国土资源、工商、水利、价格等行政管理部门按照各自职责，做好机动车洗车场监督管理的相关工作。
Article 4 The Municipal administrative department is the competent authority in charge of the carwash business for motor vehicles in the whole Musicality. The subordinate management authority under it is responsible for daily administration and supervision of the carwash in the central area in the
The urban administration departments of the county (city, districts) are responsible for the supervision and administration of the carwash in their own administrative areas.
The administrative departments of planning, construction, land and resources, industry and commerce, water conservation, the price and other administrative departments shall supervise and administrate the carwash properly in accordance with their own duties respectively.
第五条 城市管理行政主管部门应当牵头建立由规划、建设、国土资源、工商、水利、价格等行政管理部门组成的机动车洗车场管理部门联席会议机制，通报管理中存在的问题，并研究解决措施。
Article 5 The Municipal administrative department shall take the lead to establish a joint meeting mechanism of the administrative departments for carwashes together with the administrative departments of the planning, the construction, the land and resources and the industry and commerce to notice problems on administration and figure out solutions.
第六条 县（市、区）人民政府应当加强对机动车洗车场管理工作的领导，培育和扶持机动车洗车行业的发展。
鼓励投资者建设科技创新型、节能环保型以及节水型洗车系统；提倡洗车场经营者实行规模化、连锁化、品牌化发展。
Article 6 The people’s government of the counties (city, district) should strengthen the Administrative leadership on the carwash for motor vehicles to foster and support the development of the carwash business.
The investors is encouraged to build a carwash system with Innovative technology, energy saving and environmental protection and water-saving. The carwash manager shall be promoted to develop a large-scale and chain business with a famous brand.
第七条 机动车洗车服务行业协会应当加强行业自律，协助做好机动车洗车场的相关管理工作。
Article 7 The service industry association of the carwash for motor vehicles should strengthen discipline in the industry and assist with the relevant management of the carwash.
第八条 城市管理行政主管部门会同规划行政主管部门编制机动车洗车场专项规划，报市政府同意后实施。
Article 8 The Municipal administrative department shall cooperate with the planning administration department to program specific plan for the carwash of motor vehicles. The plan shall be approved by the Municipal government before implementation.
第九条 鼓励在中心城区主要入市口设置机动车洗车场，防止车辆带泥进市行驶。当地政府应当在土地、规划选址等方面提供便利条件。
Article 9 It is necessary to encourage the establishment of carwashes for motor vehicles at main entrances of the central urban areas in a city to prevent the vehicle from traveling with mud into the city. The local government should provide convenient conditions in terms of land, planning and location.
第十条 中心城区内新建公共服务设施、商业服务设施等项目，规划设置地下或地面配套停车泊位总数在800个以上，新建、改（扩）建公共停车场停车泊位总数在800个以上的，应当在机动车停车场内设置机动车洗车场。
已建成的地下公共停车场，可以按照本办法在原停车场内增设机动车洗车场。
Article 10 It is necessary to construct new projects, such as public service facilities and commercial service facilities etc. in the center district of a city. Those facilities plans with more than 800 auxiliary parking lots under/on ground or the newly built and reconstructed/expanded public parking lots with more than 800 parking places in total shall be equipped with the carwash in the parking lot.
The public underground parking lot having been built shall be increased with a carwash of motor vehicles in the original parking lot.
第十一条 新建、改（扩）建加油（气）站、充电站、公交枢纽站和客运汽车站等基础设施，在不影响公共安全的条件下，应当统一规划、建设机动车洗车场。
Article 11 Newly built, reconstructed/expanded gas stations, electricity charging stations, bus terminals, transport bus stations and other infrastructures should be designed and constructed with carwashes of motor vehicles uniformly under conditions not affecting public safety.
第十二条 经营公共客运、客运出租、货物运输、垃圾运输、工程机械施工的单位，应当落实清洗保洁措施，保持车辆清洁；也可以设置与其规模相适应的洗车场。
Article 12 Those units operating in public passenger transportation, passenger transportation rentals, goods transportation, trash transportation, engineering machinery construction should implement cleaning measures to keep the vehicle clean or shall build a carwash matching with its size.
第十三条 建筑工地应当在出入口设置专用场地，配置施工车辆清洗保洁设备，落实清洗保洁措施，保持施工车辆清洁，防止车辆带泥上路。
Article 13 Special venues shall be set at the exit and the entrance of the construction sites for vehicle cleaning equipment to implement cleaning measures to keep construction vehicles clean and to prevent them from traveling on the roads with mud.
第十四条 机动车洗车场开办者应当将给排水、污水处理系统和电力系统等与主体工程同时设计、同时施工、同时验收、同时交付使用。
Article 14 The operator of a carwash for motor vehicles should design, construct, test run and takeover the water supply and drainage system, the sewage treatment system and the power system simultaneously with the main project construction.
第十五条 禁止在下列区域设置机动车洗车场：
（一）城市主干道两侧控制区域范围内；
（二）交通拥挤地段和车流量较大的交叉口；
（三）风景名胜和文物保护核心区范围内；
（四）城市道路、广场、公园绿地、街道游园、消防通道、高压走廊、河道河堤及市政公用设施保护范围内；
（五）其他依法禁止设置机动车洗车场的区域。
本办法实行前，机动车洗车场经营者在上述区域内设置的机动车洗车场，已取得营业执照的，应当在两年内按照本办法规定另行选址进行设置。
Article 15 It is forbidden to build the carwash at the following sites:
(1) The control area at both sides of main roads of a city;
(2) Road paths with traffic congestion and large intersections with heavy traffic;
(3) The central areas of scenic spots and cultural protection relics.
(4) City’s roads, squares, parks, gardens along streets, fire exits, high pressure corridor, river courses and embankments and within the scope of protection area of municipal public facilities;
(5) Other areas forbidden to build the carwash for motor vehicle in accordance with law.
Before the implementation of the Measures the operator of a carwash for motor vehicles in the above mentioned areas who had obtained a business license shall choose a new site for the business in accordance with the provisions of the Measures within two years.
第十六条 开办机动车洗车场应当具备以下条件：
（一）依法取得营业执照；
（二）有符合本办法规定的场地、设施设备；
（三）有与经营规模相适应的清洗服务从业人员；
（四）有完善的内部管理制度、作业操作规范；
（五）符合城市道路管理、给排水、节水、环境卫生等行业管理单位的要求。
Article 16 Following conditions are essential for running a carwash:
(1) to obtain a business license in accordance with law;
(2) to have the qualified location, facilities and equipment in accordance with provisions of the Measures;
(3) to have cleaning service practitioners suitable for the size of the business.
(4) to have a sound and complete internal management system and business operation norms;
(5) to meet requirements of the administration agencies for the urban road administration, the water supply and drainage, the water conservation, the environmental sanitation and other industries.
第十七条 机动车洗车场应当符合以下设置标准：
（一）作业区应当划分洗车区、擦车区与等候区。其中，洗车区应当设置在室内或者封闭场地内，采用防渗漏硬化地面，并设置截水沟、三级沉淀池及污泥暂储设施；
（二）洗车场擦车区域面积不低于
（三）作业区地面、车辆进出口通道应当进行硬化，作业区墙体及清水池立面建造应当使用防渗漏材料；
（四）《机动车清洗站技术规范》规定的其他要求。
Article 17 Carwashes of motor vehicles should meet the following setup standards:
(1) Operation area shall be divided into vehicle washing area, vehicle cleaning area and waiting area. The wash area shall be setup in a room or an enclosed area with anti-leakage and hardened floor which shall be constructed with drainage ditches, three level sedimentation tank and a temporary sludge storage facilities.
(2) The cleaning area of a carwash shall be no less than 20 square meters;
(3) The ground of the working area, the exit and entrance should be hardened, and leakage prevention material shall be used in the construction of the walls of the working area and the facade of the water pool to prevent leakage.
(4) Other requirements in the Technical Specification for Motor Vehicle Cleaning Station.
第十八条 机动车洗车场经营者终止经营的，应当在终止经营30日前通过公示、电话等方式告知机动车洗车场管理机构及消费者。
Article 18 If Operators of the carwash for motor vehicles wish to terminate the business, they should notify the management agencies for the carwash and consumers within 30 days before the termination of the operation publicity, by telephone or other means.
第十九条 机动车洗车场经营者在经营过程中应当遵守下列规定：
（一）遵守有关法律、法规及规章规定，诚实守信经营；
（二）不得占用公路、城市道路、公共绿地或者其他公共场地从事机动车清洗活动；
（三）使用符合环保要求的洗涤剂等产品，确保循环水设施、污染治理设施、节水型清洗设备正常使用；
（四）标明机动车洗车场名称并设置导向标识；
（五）做到优质服务，操作规范有序，保持环境卫生；
（六）机动车洗车场洗车废水须达到国家或者地方规定的排放标准，并排入污水管网；
（七）定期清疏、维护污水收集管网和污水处理设施，确保排水通畅和水质达标。
Article 19 Carwash operators should comply with the following provisions in operation:
(1) to carry out relevant State laws, regulations and regulatory documents consciously, and to operate with honesty and trustworthiness;
(2) not to occupy roads, urban roads, public green lands or other public places to engage in motor vehicle cleaning activities;
(3) to use environment friendly detergents and other products to ensure smooth utilization of circulating water facilities, pollution abatement facilities and washing equipment with water-saving feature;
(4) to mark the name of the carwash clearly and prepare a direction guide sign;
(5) to have quality services and proper operating norms, and maintain health environment;
(6) to let the wastewater of the carwash meet the national or local standards before being discharged into sewage pipe networks;
(7) to clean and maintain sewage collection pipe networks and sewage treatment facilities regularly to ensure smooth drainage and qualified water standards.
第二十条 机动车洗车场经营者应当办理洗车用水手续，优先使用再生水。
禁止从公共绿地和消火栓等公共设施的供水管道取水或者非法使用地表水及地下水进行机动车清洗服务。
Article 20 Carwash operators should apply for approval for using washing water of which recycled water is the priority.
It is forbidden to use water supplying pipelines of public green lands, fire hydrants and other public facilities and it is illegal to use surface water and underground water for vehicle cleaning purposes.
第二十一条 机动车洗车服务价格实行市场调节价，提倡优质优价。机动车洗车场经营者应当在醒目位置悬挂收费公示牌，公示服务收费项目、收费标准等内容。
Article 21 The prices of vehicle washing service are regulated by deals and advantages on price with qualified service is advocated. The operators of the business shall put up publicity price tablets in striking positions with the price of each service item, charge standards and other content.
第二十二条 机动车洗车场管理机构应当建立机动车洗车场经营者年度服务质量信誉考核机制，定期向社会公示考核结果。考核内容包括场所设施、场所环境卫生和洗车服务质量等。
Article 22 The carwash motor vehicle market management agency shall establish an annual assessment mechanism of credit and quality service of the carwash operators, and the results of assessment will be posted regularly to the public, which includes assessment on facilities, environmental health of the site and cleaning service quality and so on.
第二十三条 机动车洗车场管理机构应当加强对机动车洗车场的巡查工作，对符合本办法第十五条、第十六条、第十七条规定开办条件的机动车洗车场应当建立该机动车洗车场的完整档案，机动车洗车场经营者需提供下列资料复印件：
（一）法定代表人（或负责人）身份证；
（二）场地使用（含租用）证明材料；
（三）人员配备和设施配备清单；
（四）内部管理制度、作业操作规范和经营项目价目表；
（五）安全生产管理制度及操作规范；
（六）营业执照、排水许可等相关手续。
Article 23 Motor vehicle carwash management institution shall strengthen inspection tours toward the carwash sites. The complete archives of the carwashes shall be established for those carwashes built in accordance with the provisions of Article 15, Article 16 and Article 17. The operators of the carwashes are required to provide the photocopy of following documents:
(1) The identity card of the legal representative (or the person in charge);
(2) The proof material of usage right of venues (including rent);
(3) The list of the staff and facilities and equipments;
(4) The Internal management system, work operating norms and price list of business items;
(5) Safety production management system and operational rules;
(6) Business license, drainage permits and other related formality documents.
第二十四条 机动车洗车场管理机构将收集的机动车洗车场相关资料报城市管理行政主管部门。城市管理行政主管部门应当会同规划、建设、工商、水利等行政主管部门进行现场核实并签署意见。核实内容主要包括机动车洗车场选址、设置标准、用水节水、排水设施、用电系统等是否符合要求。不符合开办条件的，机动车洗车场管理机构应当立即通知其进行整改。
Article 24 The carwash administrative agencies will collect relevant information of the carwashes to report to urban administrative departments. The urban administrative departments shall inspect and give advice together with such administrative departments as planning, construction, the industry and commerce and the water conservancy. The inspection mainly includes whether the carwash site selection, standards of establishment, water saving, drainage facilities, and electricity system meet requirements. If the carwash doesn’t meet the requirements to start up the business, the administrative institutions shall notify them immediately for rectification.
第二十五条 按照本办法第十条第一款、第十二条设置的机动车洗车场，产权人或使用人擅自改变使用用途的，依据《邯郸市城乡规划条例》第七十八条规定责令限期改正，逾期不改正的，对个人处以2000元以上10000元以下的罚款；对单位处以10000元以上100000元以下的罚款。
Article 25 For those carwashes built in accordance with the first provision of Article 10 and Article 12, if the business owner or user changed the use of the carwash without authorizations, they should be ordered to change according to Article 78 of “the Measures of
第二十六条 违反本办法第十五条规定，在禁止区域内设置机动车洗车场的，由城市管理行政主管部门责令限期改正，逾期不改正的，没收违法所得，处以2000元以上5000元以下罚款；情节严重的，处30000元以下罚款。
Article 26 Any violation against the Article 15 to build a carwash in the forbidden area, the urban administrative departments shall order a correction within a time limit. Their illegal income shall be confiscated together with a fine from ¥2,000 CNY up to ¥5,000 CNY highest for those who refuse to change after the dead line; and those with serious violation will be imposed a fine less than ¥30,000 CNY .
第二十七条 违反本办法第十七条规定，机动车洗车场经营者未按标准设置机动车洗车场的，由城市管理行政主管部门责令限期改正，逾期不改正的，可处以5000元以上10000元以下罚款。
Article 27 Those of the carwash who didn’t build carwashes according to the regulations and standards according to provisions in Article 17, the urban administrative departments shall order rectification with a dead line. Those who exceed the due time will be fined ¥5,000 CNY minimum to ¥10,000 CNY maximum.
第二十八条 占用城市道路、消防通道、绿地等公共场所清洗车辆的，由城市管理行政主管部门责令限期改正，逾期不改正的，按照《邯郸市城市市容和环境卫生条例》第七十三条第五款规定，处以500元以上2000元以下罚款，造成损失的，同时承担赔偿责任。
Article 28 Those who occupy city roads, fire exits, grass lands and other public sites to wash cars and vehicles shall be called up for rectification with a dead line given by the urban administrative departments. Whoever passes the time limit will be punished in accordance with the fifth provision in Article 73 of “the Measures of Handan Municipality on City Appearance and Environmental Sanitation” to pay a fine of between ¥500 CNY to ¥2000 CNY highest. Whoever results in damages will have to be responsible for compensation at the same time.
第二十九条 机动车洗车场经营者有下列情形之一的，由城市管理行政主管部门责令限期改正，逾期不改正的，可处以300元以上1000元以下罚款，造成损失的，同时承担赔偿责任。
（一）洗车污水流到机动车洗车场外区域的；
（二）使用不符合环保要求的洗涤剂产品清洗车辆的；
（三）其它影响市容环境卫生的行为。
Article 29 If any of the following circumstances occur, the operators of the carwashes shall be called for rectification with a dead line given by the urban administrative departments. Those who exceed the time limit will be punished with a fine of ¥300 CNY to ¥1,000 CNY highest, Those who result in damages will have to be responsible for compensation at the same time.
(1) The sewage flows out from the car cleaning areas;
(2) The disqualified detergent products that do not meet the requirements of environmental protection used in cleaning vehicles;
(3) Other conducts that affect city sanitation.
第三十条 行政机关及其工作人员在履行机动车洗车场监管职责中玩忽职守、滥用职权、徇私舞弊的，依法给予行政处分。
Article 30 The administrative organs and their staff shall be given administrative sanctions according to law if any of them neglects their duties, or any breach of privileges happens or they commit irregularities during the implementing of the carwashes.
第三十一条 各县（市、区）人民政府可以根据本办法制定具体实施办法。
冀南新区、邯郸经济技术开发区管委会受城市管理行政主管部门的委托负责本辖区内的机动车洗车场的监督、管理工作。
Article 31 The people's governments of counties (city, districts) may formulate the specific implementation measures according to the Measures.
The Administration Committees of Jinan New District and Handan Economic and Technological Development Zone are entrusted by the urban administrative departments to be responsible for the supervision and administration work of the carwashes of motor vehicles in their jurisdiction.
第三十二条 本办法自
Article 32 The Measures above shall come into force as of December 1, 2016.
